A (perhaps daft) question about the I-129f for the K-1 visa

Hi,

Currently filling out the I-129f form (this version: http://www.uscis.gov/files/form/i-129f.pdf) with my fiancée (US Citizen) and we got to section 15a (If your fiancé(e) is currently in the United States, please complete the following). Currently I am in London and my fiancée is in New York City. I will be going to visit her on 20th August and she will be filing it after I have left. As I will not be in the US at the time of filing, do we need to fill this in?

If we do need to fill it in, presumably I would be stating I am entering the US on the Visa Waiver Programme, correct? If so how would I represent this on the form? Because I don't have a I-94 record number or anything like that.

Any help/advice is appreciated!

Medical examination - 13th January 2014

Interview date - 11th February 2014

Visa approved!

Entered the US at JFK - 30th March 2014

Married! - 25th April 2014

Mailed AOS package - 8th May 2014

Recieved NOA for AOS - 12th May 2014

EAD/AP approved - 23rd July 2014

Received EAD/AP - 31st July 2014

Began working again! - 1st August 2014

You answered your own question. As you will not be in the US when the I-129F is filed you do not need to fill out that section. USCIS will put the pieces together if you use the visa waiver program to enter after filing your I-129F. Just be aware that visiting your fiance(e) after an I-129F is filed can become more complicated as you are at greater risk of overstaying to avoid the long K-1 wait. Citizens of low risk countries have been denied access to the US under the Visa Waiver due to a pending K-1.

10/23/2012 Received MNL case number from NVC

10/24/2012 Paid visa fee and scheduled interview

11/08/2012 Medical Completed

11/09/2012 CFO seminar and interview completed

11/19/2012 Interview USEM- VISA APPROVED

11/26/2012 Passport (and visa) in transit from post

11/27/2012 Visa Packet delivered/Air booked-business class all the way!!

12/05/2012 flew to Manila-CFO sticker-USA Bound

12/06/2012 Arrived USA-POE Washington DC!!!!!!!!!
