New NBI Clearance requirements: Manila?

Hello;

My finance is concerned about the wording concerning the NBI clearance. She's from Manila, & she already got her NBI clearance, but is concerned about

the wording referring also to a letter of explanation being a new requirement. Is this something they added, or are they one & the same thing?

g. NBI CLEARANCE (Green Form). Applicants aged 16 years and older must have a valid Record Clearance (for travel abroad purposes) from the National Bureau of Investigation (NBI). Clearances should be in the applicant’s current name, birth certificate name, maiden name and any aliases or nicknames used, including different spellings you have used of those names. An official letter of explanation from the NBI is required for any notation of "No criminal record" or "No pending case". For immigration purposes, an NBI clearance is valid for one (1) year from the date it was issued. The NBI website is http://www.nbi.gov.ph.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

12/11/2013 - GC received! 2 months and 1 day from the NOA1

Well what does your fiancee's NBI say? It's not a new requirement.

NO CRIMINAL RECORD and NO CASE PENDING could mean she is in the NBI's database for a past offense If I understand correctly.

If her NBI says either of those two phrases, she needs to return to the NBI and request a letter of explanation as to WHAT she is in the database for.

If her form says something like NO RECORD ON FILE or NO DEROGATORY RECORD then she has nothing to worry about.

I looked over my fiancée's NBI and she only has the wording NO CRIMNAL RECORD. So the word "NO" mean just that "NO" meaning nothing to worry abou. You are good to go.

What is the notation on your fiancée's NBI ? If it has NO CRIMINAL RECORD or NO PENDING CASE then she better get an explanation letter from NBI, if it has NO FILE ON RECORD or NO DEROGATORY RECORD then keep moving.

The letter of explanation is not a new requirement, been around for ages. The letter of explanation would be from NBI (and they are very aware its needed) IF ....

Is this confusing, because they refer to a letter saying there's no criminal record? Really it's the certificate itself that says there's no criminal record. Personally I think they are talking about the certificate here; but emphasize that people need a letter, or certificate, to show that. Maybe some people think there ok, without a piece of paper, if they have no police record.

Any further thoughts on this?

Yes they are talking about the NBI certificate, but the embassy requires am explanation letter from NBI under certain circumstances which are listed in the embassy instructions letter.

Your fiancee needs to get a Letter of Explanation from NBI.

I was not aware of this stipulation. Thanks for the heads up. I am going to look into this further and rectify with the necessary letter from NBI. Just when you think it's safe to go in the water, THE VISA SHARKS ATTACK!!! We have time so we will get it done.
