Hi friends,

I just registered me marriage yesterday . Me and my Wife have the marriage certificate now. I am planning to send all my docs to USCIS very soon.

My dilemma is that should my wife apply for change in name right now i.e. before sending all the documents ? I would need her Ids too so I was thinking that we should apply for change in name when I get my GC. But I am confused because I am assuming that documents with changed name will make my case stronger.

Also I do not want to confuse USCIS folks by having two IDS. So what do you people suggest?

You keep posting all your questions in the AOS from Family Based Visas forum but you are adjusting from a current H1b, not a family visa. If you are changing your name with marriage, then you file all your AOS forms with your new married name. The name you use on the forms is the name your green card will come in. It will be costly and time consuming to file to change the name on the green card later.

You keep posting all your questions in the AOS from Family Based Visas forum but you are adjusting from a current H1b, not a family visa. If you are changing your name with marriage, then you file all your AOS forms with your new married name. The name you use on the forms is the name your green card will come in. It will be costly and time consuming to file to change the name on the green card later.

I did my on my name wihtou changing the officer who took my biometrics told me i can ask to change at the interview, we were at the same dilemma ans we decide to do without change the name right know. but this was our option.

No. You are not adjusting from a family based visa such as a K-1. You are adjusting from your current H1b visa and that is the status you would list on the AOS forms where it asks. No. You are not adjusting from a family based visa such as a K-1. You are adjusting from your current H1b visa and that is the status you would list on the AOS forms where it asks. You are welcome.

Those adjusting from a family based visa follow different guidelines. For instance, no I-130 is needed to be filed and another medical is not required if they already had a medical to get their family based visa within the year before filing for AOS. Not everyone adjusting from a K-1 will get an interview either, which is not the case for those adjusting from a work, student or tourist visa. You will get the best answers for your case there.

We just got married last month and decided it was best to keep our last names for now. I don't want the hassle of some forms having a different name than my passport, and it becomming a huge issue. I don't have the time or money to change every piece of evidence we have.

I really don't think changing your names will make a difference, but maybe I'm wrong. A lot of people keep their surname these days. As long as you have enough evidence of being in a relationship, I wouldn't think it would matter what you're called lol.

I really don't think changing your names will make a difference, but maybe I'm wrong. A lot of people keep their surname these days. As long as you have enough evidence of being in a relationship, I wouldn't think it would matter what you're called lol.

I agree with you Derby. Only problem with changing names is the hassle of soem forms having different names than passport or you change the name on passport too which can't be done in 2-3 days. changing names on alld douemnts wil take at least 2-3 weeks so I have decided to change it after we get our GC.

It made no difference in my case and my friend's case. We both adjusted from H1B. They don't ask about it as in "Why didn't you change your last name?" during the interview. During bio-metrics the officer there did ask me what my maiden name was and I told him I didn't change my last name. He remarked that that made things a lot easier on them. *shrug*.

I didn't change my name because I had no idea how it affected my H1B status or the AOS paperwork and the information I got from the web seemed lengthy, unreliable and painful. I didn't want to land up doing something illegal due to ignorance or following wrong advice. But from my friends experience I knew that not changing names didn't affect AOS. So I went with that.
