Yes you should be able to. For instance, if your step-son and your wife were both in China and you filed both of their petitions together, then when they were approved you paid the AOS fee for both, you couldn't use the i-864ez because two people would be immigrating at that time.

But the way you describe, they're doing it separately so that should be okay.

For exact verification, talking to the NVC would be your best bet. This is my best opinion. :)

Point taken. I am curious: why do you say the NVC? I was thinking of calling the USCIS number about this (rather than the NVC), since I need to send the package with the I-130, I-485, and I-864EZ to the USCIS.

I say to contact the NVC about it since you'll be dealing with them first with your wife.

I-485??? Which one is this?

I-864 goes to NVC.

I-485 is the Application to Adjust Status, and in my situation can be filed concurrently with the I-130 with the USCIS.

The I-864 goes with this package to the USCIS. Later, if all goes well, these all get transferred to the NVC.
