yes they do

if your acpo come back with no live trace you have to produce a subject access report to show list of crimes

that caution is the only one i have for pinching a traffic cone

I'm no expert but I think it would be mad if you were denied for this.

I'm assuming when you attend the interview they might ask for more detail, giving you the chance to explain.

To have a visa denied because of one caution for theft seems a bit extreme.

I'm no expert but I think it would be mad if you were denied for this.

I'm assuming when you attend the interview they might ask for more detail, giving you the chance to explain.

its not the caution as its the exception rule i fall under

its the missrep from vwp :(

i can pretty much guarantee it will say denied need a waiver for missrep even though it was an honest mistake gutting to know but there we have it

Seriously to have extra problems as a result of taking a traffic cone is crazy. That actually sucks, as someone said practically every student in the UK has done this. In fact my student paper printed a list of things to tick off to make sure you had a good time at Uni and this was in the top 5 lol. You were unlucky to get a caution instead of being told to just put it back, I hope that it doesn't create the problems you were expecting

yeah im just hoping they look at the case see mistakes have been made i have heard of other being fine even with a more severe cimt than me but we shall see on the day and be prepared

If they ask you about why you did not declare it under the VWP, I would say you did not consider it a CIMT, as it was so minor. I have also seen someone on here who said they were not asked about answers on previous visas etc.

yeah i have heard that too dont get me wrong i can only blame myself but to have gotten a caution for this seems joke to me

i have never done anything wrong in my life i have always been a good member of the community

and honest if i knew i couldnt use the vwp i would of got the proper documentation

Chris, try not to beat yourself up to too much. The burden for a misrep is actually quite high (I forget the language, but it's essentially a deliberate action) and I'm sure you're not the first person through the London Consulate that has misinterpreted the VWP conditions. The CO will ask you about your prior criminal history and give you a chance to explain - just tell the truth and there is a chance they will see it for what it is. No guarantees obviously, but good luck - when is your interview?

No set date for the interview yet we only got our noa2 a week ago but i know it will be coming up soon just cant get it out of my mind that we will be denied as im sure it will happen

like you said its holds a big burden aka not a chance of approval

but hopefully i get the chance to explain it might make the waiver easier for acceptance

I think i will wait to the interview to gather info there is too much on my mind

and yes it was an honest mistake thats why its killing me inside as i would of never done it

honest mistake but they wont look at it that way im sure

i know others have got few <<<<< lucky people

my my luck isnt that great if i knew it was going to be this way i would of taken a diff route but it was an honest mistake

Chris, I am in a similar position to you, although my minor offence was 33 years ago and it does not appear on my Police check but I am going to tell them anyway. IF they ask about VWP etc i will just tell them

a: in my case it was another lifetime away and I have not given it a thought for probably 30 years and

B: when you read the ESTA application it does not read like you need to mention it if you do not consider it a CIMT. There is a defintion on Wiki about it for US immigration purposes, have a look there and see where you fit in.

I am waiting for interview too, just had medical and I will let you know how it goes if I get there before you, could you do the same.
