Hello all

I have a strange question

I have filed for my n400 naturalization. I am married to man, who lives out of the US. We plan to spent alot of time together, in his country (but within the 6month rule for green card holders) I have not heard anything about my citizenhip yet, but I am wondering when I get it...is there a waiting period we need to wait to be able to file for DCF. (I plan to move there in order to file for the DCF after I get my citizenship).. where would i find this info out? .thanks everyone for the help.

No waiting period after obtaining citizenship.

Example: LPRs who have a (F2) visa petition pending for a spouse, get the petition updated to IR-1 visa as soon as they obtain citizenship.

There is no waiting period; as soon as you have evidence of your new US citizenship you are eligible to file I-130.

I thought you don't even need residency in Algeria to file? Or you plan to move over and wait while he applies for his visa?

Thanks very much Dan, you sure help me alot... should I file for my husband now as LPR (f2) to get the ball rolling then switch to DCF? Or....would it be a waste of time and/or money? Thanks again for your help!!!

Yes Algerie does not require any residency to file, but I am planning to move temporarily (or you could call it an extended visit) for about 4months.Then return. Hopefully, I will not have to go back, have my interview by then...but if I have to I will go back for another 4 month run :lol: . I was assured that being out of the country for 4 months would not affect my LPR status (also I have done this before, but I was then in my own country of orgin--->not his LOL :lol: ) but I am worried (and trying to find answers) to whether it will affect my n400 application. I mean can or will they deny saying that I was out of the country too much ...why do I want to be a citizen if I am out of the country more then in (but only in the next few months)... Would making my "visit" shorter be a better idea or filing later...O snaps I am so confused!!! :wacko:

Henia, you should read the USCIS Guide to Naturalization very carefully regarding time in the US. As you get toward the application, you do have to spend a certain amount of time IN the District where you are filing. And, you must account for every day spent out of the US, so if you've traveled a lot, start adding them up.

Go over that application very, very carefully. You don't want to get caught short this close to the end! :)

Oh, on the filing I-130 now--- DCF works a bit differently, and you will not be able to re-use that petition for the DCF. If you kept it in the US, you could upgrade it but it would then go to the NVC and through the regular process.

There is an advantage to having the back up I-130 at a Service Center, filed now as a PR. If anything should go wrong with your natz, any delay etc, you would still have that petition cooking along in the background. You will of course want to cancel it in writing when your new I-130 is accepted in Algeria.

Do check out when those visits will be allowed by N-400. And what is your country of origin--you've just made me curious now! :)
