So, I've read the instructions and I'm still a little bit confused on the I-864 form. I just want to get some clarification. I'm filling out 2 I-130's petitions; one for my wife and one for her son. I'm needing a joint sponsor and my aunt will fill that role. She will fill out 2 I-864 forms; one for my wife and one for her son. I fill will out 2 I-864's forms as well.

Question on wife's I-864 form:

Part 2. Information on Principal Immigrant

I list my wife's family name, given and middle name.

So my question is on the next part...I'm guessing my Aunt and I will fill this out identically..right?

Part 3. Information on the Immigrant(s) You Are Sponsoring.

1. I am sponsoring the principal immigrant named in Part 2. YES

Will I list my wife first as #1 and her son as #2? Or will I not mention her son at all on her I-864, and only on his own form?

Family Member 1

I will list my wife's info here

Family Member 2

Do I list her son here??

I'm a little confused on if I do, or do not mention her son on her i-864...and if I mention her on his i-864. I don't want the household count to be off.

One last thing....

My recent year for taxes will be zero..will it be okay to put all 0's in the income and assets places? I assume yes, and it does occasionally happen.

And will my aunt need to put nones, n/a's or 0's in the assets? She exceeds the 125% poverty line and doesn't want to count her assets.

I know this is a lot to ask, but I'm trying to get it all correct and after reading it...it kind of confuses me a little more.

So...I'm watching a video on Youtube about filling out the I-864 (http://www.youtube.com/watch?v=WHxUmUt_LDc) and I think what I do is...

I'm not suppose to fill in anything for Family Members...I will only fill out Part 2 info, and nothing for Part 3.

1. So..I do not mention the son or wife on any other form, but their own. Yes?

2. The only thing that seems odd about it- is in Part 2 it does not ask for immigrants birthday, whereas, part 3 it does.

You have it correct above. The immigrant's date of birth is entered in another section. No worries. Remember in your own affidavit not to count your wife twice. She's already counted as the intending immigrant. Same drill on the child. Don't count anybody twice.

I know this is a lot to ask, but I'm trying to get it all correct and after reading it...it kind of confuses me a little more.

Leave the assets section blank. If your income is zero for a year, that's the correct number to enter. See the little note above the assets section that says it's optional if income is sufficient? It's also optional for the petitioner, when using a qualified joint sponsor.

So I will not fill out any Family Members in Part 3 on either form, correct?

Correct. You only list family members being sponsored on THAT affidavit. The older version indicated that but this one probably only does in the instructions.
