The website says:

[Note – if adjusting status: If you will be applying for your immigrant visa in the United States by adjusting your status with the United States Citizenship and Immigration Services (USCIS), you should contact the National Visa Center before taking further action or making payments.]

Should I do this at all?

I did not adjust status so I'm unsure what to do with your already approved I-130 since you didn't send them together. Hopefully someone else who knows will pop in! best of luck

Happy Saturday !

You skipped a bit, applying for an adjustment of status case.

Since MOST folk file the I-130 and I-485 together, they follow the guide referenced in Guide2

Now that you have an approved I-130, must to file per Guide2 with the exception of the I-130 set.

Note Guide2 speaks volumes about the I-130 - anything I-130 specific or related - SKIP IT.

However, when you file 'everything else' - include a photocopy of the I-130 approval notice, Formletter I-797....

Go Get Em, and Good Luck !

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !
Ya know, you can find the answer to your question with the advanced search tool, when using a PC? Ditch the handphone, come back later on a PC, and try again.

Thank you so much!! Do you know how much longer the I-485 process will take? All of this has already exceeded a year.

figure 2 to 11 months.

Remember, the EAD card arrives 90 to 100 days , so husband can do stuff like work and go to school .

You got your forms list listed? you know all the forms you need, yes?

Okay. From what I read, it looks like the forms I will need are:

1. My approved I-797 Approved Notice of Action

and these from the check list:

11. G-325A filled out, signed and dated. 12. I-693, Medical Examination of Aliens Seeking Adjustment of Status 13. I-864, Affidavit of Support (see poverty limits here)

>> Include any additional required supporting documentation 14. I-765, Application for Employment Authorization, if you want to work while your application is processed (optional)

>> Include any additional required supporting documentation or photos as well as payment per USCIS instructions. 15. I-131, Application for Travel Document, if you need to travel outside the United States while your application is processed (optional)

>> Include any additional required supporting documentation or photos as well as payment per USCIS instructions. 16. I-485 Supplement A, and penalty fee if applicable. See 8 CFR 245.10 17. I-601, Application for Waiver of Grounds of Excludability**, if applicable

I'm not sure if I need 16 and 17. The links from 16 don't work.

Thank you all so much! I would have never known what to do. When I got the approval letter it only said to wait for the NVC to contact me, status adjustment or any other forms etc. were never mentioned.

It has a date on it... I think a copy of your husband's student visa at this point would be good. It's to show he entered the USA legally. ( I believe, I could be wrong)

his I-94 might just say 'D/s' on it.

However - he doesn't have to be 'in status' with the student visa to file the adjustment of status.
