Hello

My Green card arrived yesterday for the first time. I entered into the united states on June with a CR1 visa while my marriage is just a 1 plus some months, to my greatest surprise i saw 10 yrs on my green card. I was thinking it will be 2 yrs then after ROC i then receive 10 but i was surprised to see ten yrs which will expire by yr 2023!

My question is thus: has anyone have same situation with me? do i need to do anything? when can i apply for citizenship?

If you received a ten year unconditional green card when you have been married for less than two years then this is a mistake. You should return the card to USCIS using an I-90 and inform them of the error they made. There is no charge for filing an I-90 when it is due to a USCIS error.

If you don't do this then when it comes time to file for citizenship down the line and the error is discovered, you could find yourself with serious problems for not filing RoC when you were meant to.

Same thing happened to my husband and now we are trying to find out what to do. He arrived first week of July and they asked him at POE how long we were married and they had him sign the letter which indicates that we have to file for removal of conditions within the next two years. Now we received a 10yrs green card for him.

We are also seeking info as to how to correct this mistake without problems later on. Good luck!

married less then 2 years on cr-1 should be 2 year green card then you need to remove conditions 1-751- married over 2 years you should receive a 10 year green card,so you get that taken care of asap.

This we know. How do we fix it? is the question. We got the same mistake made on my husband's GC. Thanks.

As I said above, file an I-90 and return the green card to USCIS.

The only thing that was written on my passport at POE was CRI and Admitted. Nothing again was written like expiration or whatever. I guess its Gods doing. I have a friend was issued 10 instead of 2yr and he has been in US for almost 2 yrs plus and hasn't changed anything.

Lets watch and see.

That's a really bad idea. If you do nothing then nothing will happen. I know it's tempting to not look a gift horse in the mouth, but established law says that USCIS errors, even if they are in your favour, are not valid.

If you fail to file RoC when you are meant to then you could wind up in immigration court with ICE attempting to deport you. It would not have been "god's will" that put you in that position, but instead your own inaction when you could have fixed the situations easily but chose not to.

Just a reminder, if the mistake on the green card is the fault of the USCIS, which it is in this case, then send the I-90 and the green card free of charge. Use the flat rate priority envelope it was send in (or get a new one if you destroyed that one to get to the green card.) I kept mine for such a purpose and they intend it as such. You do not have to pay any fees to fix a USCIS mistake.

We did an I 90 on the card date issue still stands as issued for 10 year card. Good Luck, you know it is their playground.

Sept.12 2012- got Married to my best friend(Ms.Keyzz)

Nov.01 2012---- my wife went back home

Nov.08 2012---sent I-130

Nov.13 2012-- I-130 Case accepted and routed to U.SCIS National Benefits Center for processing

Nov.24 2012-Received R.F.E I-30

Nov.26 2012--Sent I-129f

Dec.24 2012--wife came back up for Christmas & new years

2013-01-04---I-130 approved

2013-02-04 ---send a letter to Cancel I-129f (can't remember date )& decided to file I-485

2013-04-15-sent I-485, I-130 approval hard copy and I-765 applications to lock box, Chicago, IL

2013-04-20- came back with a note stating the amount was wrong

2013-04-22- i-485 packet send to lock box, Chicago, IL ( the correct amount this time)

2013-04-25- email saying Case I-485 Case accepted

2013-04-29: Received both I-485 and I-765 NOA's hard copy in the mail and the Biometrics appointment letter

2013-05-21: Biometrics done & stamp on my I-797c

2013-05-31: check case on the USCIS web page & its said (your I-485 status is ready for Testing and Interview schedule ( NO EAD CARD)

2013-06-10-hard copy interview letter was mail( NO EAD CARD)

2013-06-12:case updated from testing & Interview schedule to Testing and Interview ( NO EAD CARD)

2013-06-15-Got hard copy A.O.S Interview letter in hand dancin5hr.gif( NO EAD CARD)

2013-07-10 - got a letter from NVC with a case number ( which we cancel from 04. feb. 2013)

2013-07-17- A.O.S approved on the spot ( less then 20 mins)

2013-07-18- Green Card was send out by usic
