I am currently unemployed but in the process of finding a job. Since I am unemployed, I have no income to sponsor my spouse, but I will use my assets. My mother can co-sponsor my spouse with her income and I am her dependent. My spouse can also use her own assets and income.

My question is, should my mother file the i-864 and I file the i-864a, or vice versa? Or other forms?

Any advice is much appreciated!

(I am the US citizen and I am just using my wife's account incase the account information is confusing)

as the petitioner, you are the primary sponsor, even if you make $0, so you must file the i864

now does your mother live with you and will live with you? if so, then she can file the i864A. if not, then an i864

yes, my mother lives and will live with me. Should she still file the i-864a or the regular i-864?

Another question, if my brother lives with me and he depends on my mother but not me, do I have to include him in my household size?

Currently I have my spouse/person I am sponsoring, myself and my mother, making a total of 3 members. My brother WILL NOT be co-sponsoring.

Your household count is 2; you and your husband. Because your income is zero, then you need a Joint Sponsor. Your household count is therefore irrelevant.

The relevant household count belongs to the Joint Sponsor.

Your mom's houehold count includes her, the intending immigrant, and her tax dependents.

Are you and your brother her tax dependents?

If yes, then her household count is 4.

If one I you is a tax dependent and not the other, then her household count is 3.

If neither of you are her tax dependents, then it's 2.

Ok. But if my mother can just use i-864a as household member instead of joint sponsor, would we have to include my brother in calculating the income requirements? I've read that he could be excluded since he is not my tax dependent.

He's your mother's dependent, so she has to count him in her I-864a. When you combine her household with yours; you get 4. Edited by aaron2020
