Hey Apple21

How did they inform you that you have to submit it - I mean did you get an email from them or something? I didn't get any correspondence from them whatsoever?

I just called NVC and they told me it will take another 20 business days for them to ACCEPT the DS260 that we will submit online.

Unless we get an email from them - I don't think we will have to file out the DS-260. It really would go contrary to common sense. Also on the Haitian US Embassy's website it says specifically that only those who submitted theirs after Sept 1 have to do it again.

Maybe the person who you were speaking on the phone didn't know the updated information accurately. When I called them last week about this they said they had no clue what I was talking about. I think you should wait unitl you get official notification from them, don't presuppose and lead them on in any way. The fact that you can access those links on that link just shows you that those documents are now available online for anyone to fill, it doesn't mean in particular that people whose IV has already been accepted have to fill it out again.

09/03/2013: All Right, Here is State Department Telegram to Visa Posts for DS-260 Online Processing Guidance for Immigrant Visa Applications Which Are Just Posted


  • Here is the timelines and guidelines:
    • Effective September 1, 2013, the DS-260 Immigrant Visa Electronic Application and the DS-261 (Choice of Address and Agent) will replace the paper-based DS-230 Application for Immigrant Visa and Alien Registration (parts I and II) and the DS-3032 (Choice of Address and Agent). Worldwide Use of DS-260/261 for New Cases Mandatory.
    • Beneficiaries submitting new cases that arrive at the National Visa Center (NVC) from U.S. Citizenship and Immigration Services (USCIS) on or after September 1 will be instructed to complete the DS-260/261 in lieu of the DS-230/3032. DOS will update travel.state.gov to reflect this guidance and will remove the PDF versions of Forms DS-230 and DS-3032 from public circulation. If a beneficiary submits a DS-230, NVC will instruct him or her to re-submit a DS-260.
    • DOS will not require DS-260s for beneficiaries of "pipeline" cases already in process at NVC on September 1 if: 1) the case has already been documentarily qualified and sent to scheduling, or 2) NVC receives a single submission of documents that makes a case documentarily qualified.
    • For all other pipeline cases where NVC has occasion to send a "checklist" of missing documents after September 1, NVC will instruct petitioners/agents/beneficiaries to submit the DS-260 along with those missing documents, even if a DS-230 was already on file.
    • Those filing petitions locally overseas (with either USCIS or a consular section) on or after September 1 must submit a DS-260 once the petition is approved. Posts should instruct beneficiaries to enter the principal applicant's DOB in YYYYMMDD format in lieu of an "Invoice ID" on the DS-260 login page.
    • For cases filed locally overseas prior to September 1, if beneficiaries have already submitted a DS-230 or received instruction to do so, DOS should accept the DS-230. If DOS have not yet provided beneficiaries instructions on how to submit their applications, DOS must require the DS-260. DOS should not, as a general rule, require the submission of a DS-260 if a valid, signed, unexpired DS-230 is already on file and requiring the DS-260 would result in a 221(g) refusal for an otherwise issuable case.

I call NvC today and the operator told me that i have to summit ds260. I summited ds230 on 5 august. No email yet

05/11/2012: Priority Date

06/18/2013: NOA2

07/12/2013: got case number

07/16/2013: DS3032 sent

07/20/2013: AOS invoiced and paid

07/31/2013: DS3032 accepted

08/01/2013: IV invoiced and paid

08/05/2013: AOS and IV package sent

09/05/2013: AOS checklist received and responsed

10/03/2013: case completed (AOS checklist #2 to be presented on interview date)

There you go that solves the problem! We are pipeline cases our cases have been approved already so we don't have to file any DS-260 or DS-261 until they specifically ask us to by email. Don't worry about what they tell you on the phone. Else you can always refer them to this notice. Wow that was one scare they made us go through :'( another 4 weeks would have been really depressing at this point.

dear shabbera did you have the same experience when you try to sign in to ds260 ? it's normally when it says you didn't fill ds260 because we hadn't filled before.

when you sign into fee payment you should not get any fault in system .

so i think ds 260 is for person's who got their case number recently or did not fill up ds 230 yet ...

i'll call nvc today to be make sure.

No I am not reading it like that at all. The reason you can sign in to DS260 is that it is made available online for everyone who has paid the IV fee. The IT staff at the NVC doesn't look at who is uploading that information, basically anyone who paid can fill out that form. Since we already submitted a DS230 and it got accepted, and if you read the Telegraph posted earlier that was an internal Dept of State notice, it says quiet clearly that anyone who has

  • DOS will not require DS-260s for beneficiaries of "pipeline" cases already in process at NVC on September 1 if: 1) the case has already been documentarily qualified and sent to scheduling, or 2) NVC receives a single submission of documents that makes a case documentarily qualified.

So 1 is for people whose case is complete, 2nd is for those whose case is not complete but their IV was accepted. Now if they mean IV and AOS both have to be accepted, then that is a different case altogether, but DS-260 has nothing to do with the AOS processing, it has to do with the IV processing, that's why I don't think if your AOS is still pending then you have to worry about it.

BTW I'm just curious where did you get a hold of this link - was it sent out by a lawyer's forum or something similar like a lawyer's mailing list?

IV accepted as of Aug 20ish

AOS pending checklist response approval, its been 9 business days so far so perhaps 5-7 more to go.

would you tell us in which steps is your case ? waiting for case complete ? did u get any checklists ?

You have to sign in on the site. Enter your case# and IIN. There you will see if you need to fill up the DS260 or not.

I called NVC a little while ago and YES the lady said I have to submit the DS260 even if I already submitted the DS230 and civil docs to them.


What should we answer here?

Do you have documentation to establish that you have received vaccinations in accordance with U.S. law?
