Hello!

I entered in the country with K1 visa and got married last Tuesday. We will finish the package and send out on Monday, but I have some doubts.

Below is everything that we will submit.

  • Two passport-style photos
  • Form G-325A, Biographic Information
  • Copy of your government issued photo identification (My passport, right?)
  • Copy of your birth certificate ( Do I need to translate it to English?)
  • Copy of passport page with nonimmigrant visa
  • Copy of passport page with admission (entry) or parole stamp
  • Form I-94, Admission/Departure Record (When I entered they said that now is online, I just print my I94 online, should it be a problem?)
  • Evidence of your marriage to the U.S. citizen within 90 days (for K-1s) (Marriage certificate, right?)
  • Form I-693, Report of Medical Examination and Vaccination Record, if applicable (I don't need it since I did my exam in Brazil last May)
  • Form I-864, Affidavit of Support ( Do I need to include my Husband passport or birth certificate copy?)
  • Copies of any other approved application or waiver you have had in relation with your application for K status (Approved Form I-129F, Form I-601, Application for Waiver of Excludability, etc.) ( Copy of Noa1 and Noa2, right?)
  • Applicable filing fees

Do I need to send any evidence as a bona fide relationship? Like pictures, leases, etc?

  • Evidence of your marriage to the U.S. citizen within 90 days (for K-1s) (Marriage certificate, right?) <--Yes. Copy of the certified marriage certificate you get back from the court after your marriage is registered.
  • Form I-693, Report of Medical Examination and Vaccination Record, if applicable (I don't need it since I did my exam in Brazil last May) <--If you had all the required vaccinations at the time of your K-1 medical, then just include a copy of your DS-3025.
  • Form I-864, Affidavit of Support ( Do I need to include my Husband passport or birth certificate copy?) <--No, Only a joint sponsor needs to prove citizenship or that they are a permanent resident.
  • Copies of any other approved application or waiver you have had in relation with your application for K status (Approved Form I-129F, Form I-601, Application for Waiver of Excludability, etc.) ( Copy of Noa1 and Noa2, right?) <--Just a copy of the NOA2 approval notice from the I-129F is needed.
  • Applicable filing fees

Do I need to send any evidence as a bona fide relationship? Like pictures, leases, etc? <--No. Save that for the interview if you have one.

Yes I will apply for both.

In that case you will need to add two more photos each for EAD and AP (so 6 in total) plus there is extra copies of supporting documentation needed for those. The link that Jay-Kay gave you is very useful (I kinda wish I'd found that when I submitted our AOS, EAD and AP!)..

I just need to translate my birth certificate because I didn't do it in Brazil. :(

I have a copy of my marriage certificate... to send to USCIS can I just photo copy or do I need to go to court again and ask for a new certified copy?

Does the beneficiary also need to submit his/her birth certificate? I have my passport so do i still need to submit my birth certificate?

Just a copy of the one you got back from the court. No need to go get another one.

Officially, you need to send a copy but I have heard of people who have received an RFE for not including a certified copy - see point 8 in the I-485 package.

I had 6 certified copies of our marriage certificate done when we picked it up as I knew I was likely to need several during the coming months. If you only have one certified copy, you may have to send a photocopy of that as you will probably not want the original to leave your hands.

I believe you are not supposed to reproduce a naturalization certificate or birth certificates either, but that is really talking about not making copies for anything other than lawful purposes I would think. People send in copies of their passports, birth certificates, naturalization, marriage certificates and divorce decrees to the USCIS all the time. You are not doing anything wrong in doing so. However, if you get cheap copies of your marriage certificate from the court, then sending them one straight from the court is no problem at all. Some folks go that route too, like you did.

At the copyshop that I had my copy done they said that it is forbidden to make COLOR photocopies of the certified marriage certificate - black/white was not a problem though. Go figure.

At the copyshop that I had my copy done they said that it is forbidden to make COLOR photocopies of the certified marriage certificate - black/white was not a problem though. Go figure.

That kind of makes sense. If you're doing a color copy, you may be accused of trying to pretend it's an original. If you do a black and white copy, then it can't be mistaken as a certified copy.
