Hello everyone. My grandfather, who is a naturalized citizen of the United States of America and has lived in the USA for 23 years, is going to sponsor his married son along with his son's family. I have many questions, but before that, let me tell you guys about the family and situation. His son is above the aged of 21 and is currently married and his children are minors except for one who is now aged 21. They are Citizens of Vietnam and are currently living in that country. My questions are:

A. If my grandfather sponsors my uncle, will his children and spouse will be included in the petition? Or does my uncle have to file a separate petition for his kids, and spouse once he arrives to the USA? What about my uncle's son who is aged 21?

B. Is the I-130 fee for each person or a single fee for my uncle and his family?

Thank you for your time.

A. Your uncle, his wife, and children under age 21 are included. The 21 years old is not included.

It takes 12 years for a USC to petition a married child.

Any child who turns 21 during the 12 years wait will age out. CSPA have save them, but there is no way to know if they will get visas until the Priority Date becomes current in 12 years.

Once your uncle gets a green card, he can file for his unmarried children over 21. That will take 8 years. He cannot file for married children.

B. Your grandfather files only for his son. The son's wife and unmarried children under 21 are included in the case for the son. Only 1 case, so 1 I-130.

Sweet! Thanks Aaron. I wonder what is the average wait time for visas?
