Hi all

I have been searching and searching but couldn't find a definite answer to our situation:

We are about to file for a K1 :D

My fiancee (she is the USC) married a German in 2000 while he was in the US on a journalist visa. So she did not file a petition for a K1 or K3 but he applied for a Greencard and it was approved (that is how she described it, I think they filed I-130?).

So should she answer "Yes" to question 11 "Have you ever filed for this or any other alien fiance(e) or husband/wife before?" I am referring to this thread http://www.visajourney.com/forums/index.php?showtopic=34618 where the USCIS considered a I-130 to be a "YES".

Any ideas?

2007-08-17 interview - approved!

2007-10-17 filed for AOS and EAD

2007-10-25 NOA1 for both applications

2007-11-19 RFE for AOS

2007-12-11 received letter with AOS interview date (Feb 2008) but none for biometrics appointment

2007-12-28 EAD touched

2008-01-07 Infopass: EAD approved on 12/28, status online not updated, received biometrics appointment

2008-01-26 Biometrics appointment

2008-01-28 EAD Card Production ordered, AOS and EAD touched

2008-01-30 EAD Card Production ordered again

2008-02-20 AOS Interview, verbally approved

2008-02-28 approval notice per mail.

Yes the answer is YES even AOS in country from another visa type requires an I-130 petition to be filed, so she filed a "Petition" for her former husband.

Is now a US Citizen immigration completed Jan 12, 2012.

Thank you, that is what I assumed.

We will put a YES. I just was not sure because the form itself seems to relate to K1 or K3 only.

uffff waiting is not easy and we have just started the process....

2007-02-21 POE LAX - Fiance and her daughter enter the USA together, Easy-Peasy!

2007-03-05 Wedding in USA

AOS Journey:

2007-06-07 AOS for spouse and daughter sent

2007-06-16 NOA's arrive, (issued on the 13th)

2007-07-05 Biometrics

2007-07-13 Received RFE (Mailed on July 3rd)

2007-08-06 Returned RFE

2007-10-16 Interview date

2007-10-27 Green Cards Received!

ROC (I-751) Journey:

2009-07-24 Joint I-751 for spouse and daughter sent

2009-08-03 Received NOA1 dated 7/27/09

2009-08-03 Received Receipt and one year extension for wife

2009-08-03 Received "Verification Of Incusion Of A Dependent" for step-daughter

2009-08-27 Biometrics

2009-11-13 Green Cards Received

Just in case anyone else is in the same situation:

This post in the IMBRA forum links to this article and it says previous I-130 IR and CR-1 petitions do NOT affect a K! or K3 petition regarding IMBRA/multiple petition regulation.
