Congrats all! For those of us tracking this, it might be helpful for K-1s to indicate whether or not you live in a state that recognizes same-sex marriage. The ones I have seen be approved with no RFE are from states with SS-marriage. i have seen RFEs for people from non-SS states.

Very interesting. I hope I'll be among those breaking that pattern as we reside in FL!

If non-SS-marriage state, what did you put for your plans to marry in a different state? TIA!

My partner and I are in that situation.

In addition to the usual soundbite for the "Letter of Intent", we both simply added at the end of the letter that the wedding will be performed in the state of Massachusetts, which currently allows same-sex marriages, regardless of where one resides within the United States.

Hope this helps others who still have to file.

I have been with my fiance for 10 years, 10 wonderful years. I can't say it hasn't been tough, but I think I have had it easy compared to other people. I live in El Paso, TX, which is just a border hop to Ciudad Juarez, Mexico, where my fiance lives. Jumping back and forth on a daily basis has been hard, but I would do it all over again in a heartbeat if I had to. The day section 3 of DOMA was demolished I was with my fiance. I sat staring at the TV in disbelief. I was scared, excited, happy, and nervous all at the same time. I started working on the I-129F application that same day.

Hi:

I was in that situation for about the same amount of time, same cities :-). My wife got an H1B and then we moved to Conroe, Tx where we were living together but still worrying about H1B coming to an end. DOMA down and we went to Iowa and got married on August 7, 2013. We finally sent the papers on Oct 1. Hopefully all is going to be well for both of us. I miss the sunsets :-)

The very best of luck on your continuing journey together. It was such a good day when section 3 of DOMA was demolished. Same sex couples should have been given the same rights long ago.

Just a question on your petition. You sent a number of photos but what did you send to show that you have met in the last 2 years (obviously, I know you have been in a relationship for the last 10 years). As you have presumably driven back and forth over the border, you don't have airline tickets/boarding passes like those of use that travel 4000 miles!

They can check how many times and when they crossed the border specially since they required USCs the use of a passport or passport card to cross. The Mexican national probably had a border card.

INTENDED STATE OF MARRIAGE

Information you provided on your Form I-129F indicates that you and the beneficiary are the same gender. Please identify the state in which you intend to celebrate your marriage and submit a copy of the relevant state's marriage laws permitting people of the same gender to legally marry.

And there it is. Getting everything ready to overnight on Monday and NOA2 here we come!!!!!

Interesting they are asking for marriage laws of intended state of marriage. I did not know they were allowed to ask that. Hopefully new filers will know to put that in their statement of of intent. Luckily we did say where we plan to marry, but still waiting for NOA2 anyway.

Even though I reside in California, my letter of intent did specifically state that I would marry in California within in 90 days. I do see some same sex visas application that have passed the NOA2 stage that where not in the select marriage equality states, that did not have a RFE.

I live in Massachusetts - where it is legal, however I did not specify anywhere that we intend to marry in Massachusetts. I did not receive any RFE or have any issues so far with the process.

We just got our NOA2 online last Tues. Oct. 1st - Got another update Oct. 3rd saying it was sent to DOS, and just received the hard copy NOA2 in the mail yesterday.

I hope they aren't making it more difficult for same-sex couples - We managed so far with things going smoothly, I just hope it stays that way!

Congratulations to all NOA2 recipients!!! I think getting RFE depends on petioner's state of residence. Which makes sense because we obviously cannot marry in Texas, which is where I'm from, and they need to make sure our intent is to marry in a state where it is allowed. I actually got the information requested for my RFE in the mail yesterday. I sent it through Express Mail. My only concern now is that I did not waive signature and the return address was a P.O. Box. I tracked it online and says the post office received package and it's ready for pickup. I'm wondering it the Texas Service Center has some sort of arrangement with USPS to pick up mail randomly at the post office.

So my RFE package was picked up by INS EXPRESS today and signed for by M. Salcedo. I was worried because I forgot to waive signature, but it looks like the packages are actually held by USPS until someone picks them up the next morning regardless of waiving signature or not. I hope everyone else that has received an RFE has had an opportunity to promptly send back they paperwork. Now we wait...........

my NAO2 was 8/22. no RFE's!! the ones that folks have been saying they get are, in my opinion, discriminatory!! We shouldnt have to show proof where we intend to marry at this stage of the process. I received my NVC case number last night, FINALLY!!!!!! hopefully will be complete with packet 3 and scheduling the interview soon. I will make sure though, that with all the RFE's happening to same sex couples, that I will bring proof etc of where we will marry to the interview just in case they want to ask it at that point.
