Im not sure if this is the right section (sorry if it isn't) but as I am applying for an adjustment of status i came here.

Me and my fiance (he is American I am British) are getting married on the 8th. we have all our paperwork ready to fill out and are wondering about my last name.

After we are married, I would like to change my last name to his, this is complicated in texas already.. but what does this mean for my AOS paperwork? If I change my name, should I put my new surname on the paperwork, or the surname I had when I got here? which would also be the name on my passport too.. would I have to change the name on my passport before sending it?... because that would be opening a whole new complicated process.

confused.. please help ! unsure.png

I think it will be a lot easier if you fill out the i-485 paperwork with your "new" name. Just make sure you sign the marriage license with your new name :-)

Have you applied for a social Security card yet? if not - go in now and apply with your your passport in hand. After you get married bring a notorized copy of your license with your "new" name and passport and they will issue a new social Security card with your new name on it (at least they did for my fiance/wife). Makes filing taxes a lot easier too.

Use the name you will be legally using from the time you marry on all your AOS forms. If you are changing your name when you marry, then your AOS forms will have your married name on them. Where it asks for previous names used, then list your maiden name. The name you use on the forms is the name your EAD/AP and green cards will come in. If you get them in your maiden name, it will be costly and time consuming to change the green card later. The copy of your marriage certificate you send with your AOS paperwork will act as the legal name change document for the USCIS.
