What should I do, please?

Hey All...it's been a while!

My children have been here for 2 months (tomorrow) now. My husband just had his final deportation court date on Tuesday (adjustment of status, here we come!!!! Yay!) and all is well here!

All except this darn journey we are still on.

My boys POE'd at JFK alone. I was not there with them. When they finally reached me in Chicago, I looked at their visas. They were untouched. Not a stamp in sight. I immediately made an InfoPass in Chicago. They acted like I smuggled the boys in since there was no record of entry. After a couple of incompetent people, the third lady stamped the boys passports. I told her she classified us wrong (she stamped cr-1 instead of cr-2) and she said that she had to do that and to make an appointment downstairs to get it fixed.

Second attempt at an InfoPass - he said he couldn't fix it and I had to email the Texas service center. Sigh. I emailed them 2 weeks ago and no response.

Anyone have any ideas on what to do next? I haven't even ordered/paid for their green cards yet because I don't want the 2 year and have to remove conditions. They should have their 10 yr.

09/19/2011 - noa1 received

3/16/2012 - case sent to my local USCIS office for additional processing

4/21/2012 - AP. If we haven't heard from them in SIX MONTHS (omg) we can feel free to call them!!! Thanks!

9/20/2012 - Interview scheduled - October 3!!!!

10/3/2012 - Interview went well but she must look at his A-file more before decision.

10/12/2012 - I-130 APPROVED! APPROVED! APPROVED!

KIDS' CASES

04/20/2012: NOA107/20/2012: instead of an approval, we got thrown into AP. sigh

11/01/2012: Boys' I-130 interview set for November 28, 2012.

11/28/2012: I-130s APPROVED! APPROVED! APPROVED!

NVC

12/14/2012: NVC Received

12/31/2012: Case number/IIN

12/31/2012: DS-3032 sent

01/08/2013: DS-3032 accepted

01/02/2013: AOS bill0

1/03/2013: AOS bill shows PAID

01/04/2013: AOS package sent

01/09/2013: IV bill

01/10/2013: IV bill shows PAID

01/11/2013: IV package sent

01/23/2013: Case complete

02/01/2013: Interview scheduled

US Embassy Lagos

02/22/2013: Embassy received

03/01/2013: Medical

03/20/2013: Interview - was told the boys would have been approved on the spot if they had pics! Errrr :-(

04/15/2013: DNA test

05/15/2013: Emailed embassy BEGGING them to let boys drop off passports for visa insertion. IT WORKED!!!

05/31/2013: Visa in hand

06/02/2013: POE JFK!!!!!!

No, sorry...she stamped CR-2 instead of IR-2.

infopass? local uscis office? apologies, that's the wrong place.

instead - please go to a CBP (Customs and Border Patrol) secondary-inspection or deferred-inspection office,

and get it sorted with the supervisor there.

You may have a hope at CBP, even with USCIS involvement - normally it's CBP that fixes these things, and NOT USCIS.

Sorry for not replying earlier.

Chicago CBP cannot do anything for me as the kids didn't POE here. I have been given the supervisor's name and number at JFK and will call on Monday to see what he will do.

Also, I received a letter from the Texas Service Center saying that I haven't filed for their green cards yet, and once I do so, I can then file an I-90 to fix the green card. This seemed ridiculous to me as why would I file for a WRONG green card only to have to pay $1000ish (for the 2 of them) to get them fixed? Then it popped into my head that maybe since it was THEIR error, I don't have to pay the I-90 fee?!?!?

Will call USCIS on Monday first, see if I would have to pay for the I-90. If not, then I will go ahead and order the green card and then file the I-90. If they are going to make me pay, I will contact JFK and see what they can do for me.

You need to go a deferred inspection site. http://www.cbp.gov/xp/cgov/toolbox/contacts/deferred_inspection/overview_deferred_inspection.xml
