Okay so this is it! my husband is going to file papers for my 4 year old son to come over to the US and its the I-130 and we're all excited about it! plus he will adopt my son too so we'll have the same last names, (what an awesome hubby).

I came here in the US with a k1 visa not k2 coz we're thinking before that we need my ex-bf's signature for my son to come over since my son is using his last name, and then we discovered that it is not important so here we are panicking to get my son over..

the situation is i cant go back to the PH coz im pregnant! so we've decided to let my mom come over with a tourist visa. QUESTION: how many months does it take to get a tourist visa? What form do we need to submit for her papers? also since she doent have a job my husband will be sponsoring her.

i need to know how many months does it take for her to get a tourist visa so well know when to file her papers, are we gonna file it together with my sons I-130?

"Sponsorship" is not required in applying for a tourist visa. Your mom has to prove that she has strong ties to the Philippines and that she will be returning.

UK_Fan Thank you i will check online so i guess ill file my sons I-130 first? how long does it take to get him here too? apple21 does she need land titles for that? what if shoe doesnt have anything coz i guess everything is under my dads name, so is sponsorship a good thing to do? plus will she have a medical exam too? what about my son?

there is no sponsorship for the tourist visa at all. if anything, it might hurt her because the CO will look at her file and see that she has no real ties to the country, but has a rich son-in-law (might not wanna leave)

i would file the I-130 first because it will take longer, but in the mean time, have your mom collect every piece of evidence that she has ties to the Philippines, otherwise she won't get the visa.

don't take this as an example, but my mom went through the russian embassy a month ago and they asked her 5 questions and didn't ask for a single paper that she brought in, so it's better to be prepared then not - never know

UK_Fan okay got it i will ask her about land titles and properties under her name, also do you have any idea about how long the process is for the I-130? coz we're planning of sending my sons papers next week so he'll be here hopefully next year, does my son needs to have his passport first before sending out his papers? coz in the i-130 form they did not ask for my sons passport number.

Your son's passport is not a requirement in filing the i-130. However, it will be needed in the NVC stage so I would suggest getting one ASAP.

You will have to execute a Special Power of Attorney (SPA) for your mother, since she will be the one assisting your son in applying for a passport. The SPA must be notarized by the Philippine Consulate who has jurisdiction over your area and must be authenticated by the Department of Foreign Affairs Manila.

Your son will immigrate in more or less a year.

apple21 so i will write a letter for my mom that is notarized for her to show to the DFA in my city? since shes the one assisting my son?

hopefully my son will be here in a year gosh i cant wait smile.png

I'm not sure if its a "letter" format. The people at the consulate can assist you though. idea9dv.gif

After executing the SPA, you will mail it to your mom. Then mom should bring it to DFA to have it authenticated.

After she gets the authenticated SPA, she can present it at your son's passport application. You can refer to the link I posted for the steps on how to apply for a passport and other required documents.

apple21 so ill get the SPA form at the consulate online? http://www.philippineconsulatela.org also can my sons dad apply for my sons passport since my ex-bf's last name is the one that my son is using right now? so it wont take a long time to process like the one mentioned above?

Okay got it I have the SPA form now, i just need to fill this up and mail this to my mom.

Have it notarized at the Philippine Consulate first before sending it to your mom.
