If it would kill you that he met someone else I would suggest that you get therapy. If he cmes back I suggest you both get therapy. Remember if you signed the affadavit of support you are responsible

Statements like THAT ("you are responsible") are why I try to remind everyone that the I-485 I-865 is not some death sentence and there are ways around it, and not something that needs to be feared horrendously.

Statements such as those made by Rubyshoes, which are deliberately designed to be provocative are why I try to explain to people that this is not a sword hanging over their head, it is RARELY if ever used, and people should not be ascribing all the doom and gloom to this that they are.

Also, for such an idiotic statement, if they haven't gotten married yet, they haven't filed for AOS, and the form for "support" you send to the Embassy is NOT the same as the I-485 I-865 you file after marriage.

Did anybody happen to notice that the Op was a newbie? The poor thing came on here to get a little sympathy, advice, and encouragement. Instead the post was turned into an English Major cat fight. A appreciate your ability to write intellectual bullshit but the poor OP never came back. Shame on you. 3 pages of ####### and only a couple of real answers. Visa Journey has sunken to an all time low. You should be ashamed. This sort of sparring should be taken to PM's or perhaps a barroom brawl. People come here for advice, not to be impressed by your writing skill!!!!

It's the old "if the OP never comes back, did they miss any intelligent replies" question....

It's kind of amazing how the word "bullshit" makes it past the censors, but the word ###### (without the bull- prefix) doesn't, don't you think?? But I guess "#######" is a reasonable substitute, all things considered.

The I-134 is not all that legally binding. And it only lasts 90 days.

You are no longer responsible after that.

OP, I'm sorry this has happened to you.

Hey Alex...I think you are mistaken on the liability clause of the I-134. Section 3 of the instrucitons clearly state (as was explained to me by my immigration attny) that the liability exists for 3 years. I believe I have read that elsewhere on this website as well. Bottom line if you bring an alien here and have signed an I-134 promise to support, the government can hold you to it for 3 years.

The I-134 is not all that legally binding. And it only lasts 90 days.

i am new here with such a sad and unbelievable storyi have no idea where to start from.our story was a fairy tail ,,,a love story that started online and ended up here in the us.after a long and tiresome k1 procedure we managed to get together and finally my dream come true as the love of my life made it to the usa.however,and when i thought that the happiness is finally on our side ,things took another shape and misunderstandings showed up and our life together became something i have never expected.anyway after all that he run away and went somewhere else . we haven t get married yet and i am so confused now that i don t know what to do .

does he have the right to stay here away from me ??? does he have the right work ??? i m so afraid he ll meet somebody else "that would kill me " in that case does he have the right to marry her??? what about his status here ????

please i m in a desperate need of an advice....thank you

He does not have the right to work. If he does not marry you within 90 days of entry to the U.S. he will be out of status. He can not use the K1 visa that you petioned to marry someone else and gain status through that visa. He can however marry someone else, however I would think the immigration service would not look kindly on him entering on a K1 then marrying someone else.

Hopefully he will return and you can work things out. Outside of this I'm not sure what you can do.

YOU KNOW WHAT U SHOULD TAKE THIS ADVICE FROM THE OTHER VJ'ERS. ACTUALLY U SHOULD BE PRAYING THAT HE DOESNT RETURN. Immigration-wise, he is OK for 90 days, as the others have said. Then, if he does not marry YOU (and only you), he must return to his country.

From the information you have provided, it sounds like you might want to reconsider marriage to this man, even if he were to re-appear and want that (which may happen if he realizes his position immigration-wise).

Please do be very careful... it sounds like fraud on his part (using you to get to the US) is a very real possibility here.

If he returns before the 90 days are up, and wants to get married, BE CAREFUL. If he does not return before the 90 days are up, he has blown his chance with you immigration-wise anyhow and I think you should contact USCIS and let them know what has happened.

I know it doesn't help to say "there are so many fish in the sea" when you wanted THAT fish, but really... you deserve better. Now is the time to reach out to friends/family/counselor of your choosing.
