traveling to the US after filing form I-130

My husband has a B2 (tourist) visa valid until 2022. He lives in Brazil and we just filed the I-130. I live in the US. Would there be a problem for him to come visit me during this time? Will he be turned away at a point of entry because he's traveling on a tourist visa during the time we are going through this process of obtaining the IR-1?

Has anyone else gone through this?

No there will be no issue. He can visit US as long as he wants using his B1/B2 visa. once the IR-1 visa is released thats the time he cant use anymore the B1/B2 visa.

There are many stories of spouses trying to visit in the US during their CR1/IR1 journey. Some are allowed in, some are denied and turned around at the POE. He needs to bring proof of strong ties to his home country, such as employment letter from employer, lease or mortgage papers, etc. Plenty of stories and questions about this on here.

Section 214(b) is part of the Immigration and Nationality Act (INA). It
states:

Every alien shall be presumed to be an immigrant until he establishes to
the satisfaction of the consular officer, or at the time of application for
admission, that he is entitled to a nonimmigrant status...

This is what the law says. So be sure that spouse has proof of ties to his native country should he have to convince a CBP agent upon entry that he has no immigrant intent.

Entry or not is the call of the CBP officer. He certainly can use his visa. As others have suggested, he should bring ties to his home country. I also suggest a copy of NOA1 showing he's proceeding in a legal route. Don't lie to the CBP! Also have a return ticket and short visits go over better than long ones. :)

Best of luck

I just went to visit my husband a couple weeks ago and did get pulled into secondary. I was questioned for almost an hour but in the end they let me go through. I had a copy of my NOA 1, my lease, a return ticket, and a letter from my employer. It was rough, but they basically asked me the same questions over and over again in different ways trying to find any holes in my story. I was just completely honest and forthcoming. At one point they said that they shouldn't let me in because with my pending I-130 it shows I have intent to immigrate. I was just very straight forwarding and said I brought a copy of my NOA1 because I am doing it the legal route and I wouldn't do anything to mess up my chances of being with my husband and they stamped my passport. Good luck!
