I-130 the name linked to the A# is wrong...how can we get that changed

Hi

My case is kind of long and complicated. I will do my best to explain it in concise and non confusing way.

I am a USA citizen and my husband is from El Salvador currently both of us live in USA. In 2008 my husband had a DUI and INS end up getting a hold of him. When the INS officer took my husband's information, the officer wrote down my husband's name wrong. Because of that the A# that was given to my husband is linked to a name that is not my husband's name. Example A# belongs to Jose Perez but the real name is Jose Pedroza.

Fast forward a little bit. I petitioned my husband thru an I-130 Consular processing. We did all the paperwork with his real name (birth certificate, marriage certificate, my son's birth certificate, his passport). The I-130 was approved on January 2013, but because his A# has his name wrong all the letters and approval come with the wrong name.

The approved I-130 was not transferred to the NVC and we did not understand why, so I made an infopass and the USCIS officer explained me that in USCIS eyes Jose Perez and Jose Pedroza are two different people. We need to fix his name, but the problem its about the A# not paperwork related.

Does anyone knows how to change the number linked to an A#?

Some extra information: we do have an immigration lawyer but his answer was what he needs to research because he doesn't know what we are supposed to do... Unbelievable,.
