Help if you've had experience with this please.

We got an RFE that had an error on it. Wrong person listed on the blue cover sheet as the Beneficiary. So per an ISO we sent it back just with a letter stating a mistake had been made and please advise. He said he felt that the error made had caused the RFE and he felt that nothing was wrong and they'd proceed with the approval. Alas, another RFE has been sent and I am assuming it's for the same reason, which is they say the birth papers we sent for my wife's daughter (both Chinese nationals) was insufficient to prove she was her daughter. Most have suggested that some IO's do not have a clue as to how to read such paperwork (white book) from China and a simple letter explaining this is what Chinese nationals have at their access would suffice. We want to do more than this though and thus my post. What else can we send that will prove this relationship. We have my wife's house hold papers which shows her daughter listed as a resident there along with my wife's parents. What else will cause these people to see that this is a bonified relationship and they will finally proceed with this. We waited 18 months for anything to happen on the 130 app...now this. Seriously, my wife is so sad that all this has to happen just to bring her daughter here to be with her family. I can't say enough times how frustrated I am with the American system for immigration of legitimate family members. I sent a letter to Obama and got a response but all it said was that he was sorry that the American immigration system was broken and that he hoped that someday America would get back to one of our core beliefs and that is that family is the most important. Did you, or did you not, submit a monograph about this, as I suggested?

I was told by the ISO NOT to send anything in other than a letter explaining the mistake when I sent the 1st RFE back letting USCIS know that they had made a mistake. I asked, but he said do not as he felt it was just a clerical mistake and that everything would be OK with most likely approval coming right after they received the letter telling them of the error. This obviously didn't happen and another RFE is on it's way. I was just doing what the ISO told me to do. I of course will send the monograph of why the date on the Notarial Birth Certificate is Aug 2010 and cannot be dated her actual date of birth, but man you sure would think they've had the experience with such things many many times and not need someone to explain that this is all we can give them as far as a Chinese birth certificate is concerned. I just want to make sure this time. If I just send the letter and whoever looks at it says, "Well we need more proof!" then I just delayed it one more time. So I was asking...what others may have sent in addition to a Chinese birth certificate to PROVE her daughter is her daughter. Thanks for the reply! Rosie and Marc

I guess the only bit of arcania that I can add -

if the RFE return address is the city of a local office,

then make an infopass appointment there and sort it there.

Otherwise, I suggest Congressional Inquiry with Congressional refactoring.

Not a local office. Here's what we have. Same RFE as before. Just asking for additional evidence that will support the claim that my wife's daughter is indeed her daughter. A monograph, though possibly helpful, will not suffice to show this. All that would do is tell whoever read it that this is what you can get in China these days as far as birth certificates are concerned. It wouldn't prove anything.

We have the following:

Life Insurance policy showing her daughter as the beneficary

Many photos of them together from a baby till present but no dates on them or writing that 'proves' it's my wife and her daughter

Divorce papers setting forth her daughter living with her

Household papers showing her daughter's info and their common address.

All papers we get right now from China would be Notarial and have todays date on them, so they would be generated based on the RFE, which is not acceptable.

I tried to call the Chinese Consulate per a Level 2 ISO but she gave me the phone number to the State Department! The woman I spoke with suggested that it sounded like the ISO didn't know what she was talking about.

Any thoughts.
