So I got my NOA2 July 24th and I'm heading to NY then Georgia for my fiance's army infantry graduation in August, I'll be flyin out August 7th. And returning September 5th. Since I'm in the UK will I have to fill out the ESTA Visa Waiver Program form before I go and take it with me? Or will this in any way collide with my K1 Visa process?

You will still require an ESTA visa as at the moment you are still not issued with your K1.

It won't affect the process.

I visited my husband during the process and still needed an ESTA.

You may want to take additional evidence that you will be returning to the UK to complete the K1 in September, return flight, letter from your employer ect.

Good luck!!!

ESTA does not specifically bar you from travelling if you're still in the application process for a K-1 (or any other Visa, because until granted you have No visa), as you've not had your interview. Provided you can show you truly do mean to just hop in for the graduation you should not have a problem. As with any trip while waiting on your K1, bring your case/photocopy of NOA2 and evidence of "ties to home".

You cannot travel on ESTA once approved for the K-1 Visa (moot at that point for you anyways).

Thankyou! I just got that one done online and have it printed ready for Wednesday... as for the part about taking my NOA1 and NOA2, I don't have those, they're with my fiance's mother in New York, I only have the case number and dates of approval, could I print out the approval page from the USCIS website and just take a copy of the I-129F packet we sent? I also don't have many ties back to the UK barring my return ticket and hospital appointment letters as I'm unable to work and awaiting shoulder replacement surgery. I don't dare take the folder full of papers including my DS230 forms to show we're sticking to the process incase they stop me at customs and assume im going to stay in the US for the rest of the proces...

can she scan them and email them to you, or a take a picture?

Have your return ticket and hospital appt letters, any lease or current bills as well. It's likely you won't be asked for anything, but it's important to have. :)

I suggest a photocopy of them, not the originals incase they are lost. You need a copy of the noa2 for when you AOS after marriage. A UPS or Fedex store, even USPS should be able to help her with that. :)
