What happens if you don't get EAD and AP before the category retrogresses? Since you already filed for AOS, would it mean you are safe and you only have to wait for them to be approved?

At this point in time, can someone with a visitor visa travel to the US and file for an AOS?

My receipt numbers for I485, I765 and I131 starts with MSC and I received the hard copies of NOA1 last week. I am still unable to check the status online as I get "Your case can not be found at this time in My Case Status. Please check your receipt number and try again. " message. Is this normal?

Feb 06 2013:I-130 PD (Case transferred to Nebraska on Aug 20 2013)

Sep 27, 2013: I-130 approved.

July 31 2013: I-485, I-765 and I-131 sent

Aug 01 2013: USCIS received AOS package

Aug 06 2013: NOA 1 received for AOS

Aug 16 2013: FP notice received

Aug 29 2013: FP done

Sep 09 2013: Status changed to Testing & Interview

Sep 16 2013: Email notification for Interview (scheduled on Oct 17 2013)

Oct 17 2013 Case Approved

Oct 22 2013 CPO email received

My receipt numbers for I485, I765 and I131 starts with MSC and I received the hard copies of NOA1 last week. I am still unable to check the status online as I get "Your case can not be found at this time in My Case Status. Please check your receipt number and try again. " message. Is this normal?

Give it couple of days for them to update online. I waited for two days.

As long as you filed with a current priority date, then you will get you EAD and AP. The i 485 on the other hand, you will have to wait until the category is current again for them to approve and act upon it.

Re: the second question if someone travels to the US with a tourist visa and files for AOS right now when the category is current, that means they are incurring in visa fraud and that is ground for denial both of the entry, and the petition to adjust status. Additionally, they can be removed from the US and have their visa cancelled, plus a penalty from 2 to 10 years barred from the US. Remember that by using a tourist visa at the port of entry you are acknowledging that you do not have any intention to immigrate to the US, therefore the fraud.

It's been taking 5 days from the delivery date by the post office for many folks including my case.

Another trick though is to call your bank and ask if there are any ACH transactions pending on your account. If there is one they will be able to tell you the amount and from whom. In my case l called my bank and they tolf me l had a pending transaction from USCIS Chicago for $1070 and that's how l knew 2 days earlier that my application had been accepted b4 receiving a text from USCIS.

Note they cannot catch your check if they are not accepting your application.

Looks like they cannot find our case! When called we were asked to wait for 45 days. Hope they start sending out the biometric appointment notice soon.

I haven't... also, if anyone received biometric notice, could you kindly mention if you filed concurrently, or with i-130 pending, or with i-130 approved? The only person who received biometric appt seemed to have i-130 approved. (I filed concurrently)

I filed with an approved i-130 and I still haven't received a biometric appointment letter. Hmmm. :(
