It's quite simple. I just wrote in the cover letter that my spouse is a LRP not a US citizen and we filed under F2A category. And you need to put the yellow RFE letter on top of your response so they know what evidence was requested.

I saw quite a few people received RFE due to possible negligence of USCIS for those concurrent filers in August. I just received the i-130 NOA in the mail today. Under "preference classification" it says "203 A2A INA SPOUSE OF LPR" - so I assume this means they didn't get the case mistaken for one with a US citizen spouse?

I just checked my I-130 NOA and it says the same "203 A2A INA SPOUSE OF LPR" under Preference Classification. And I did some search to find out that "203 A2A INA SPOUSE OF LPR" is the section of the law for LPR filed I-130 for their spouse under F2A. F2A is used as a category on the Visa Bulletin. So I'm guessing there must be different group of people who worked on our cases and the RFE for US citizen evidence may be caused by some careless USCIS staff.

Yesterday I received an email from the NVC with my case number and telling me how to pay my fees. Interesting that this would be sent to me now when:

  • I marked that I would be doing AOS on my i-130 paperwork,
  • my i-130 was approved,
  • I've sent in my AOS packet,
  • My AOS packet was accepted AND check cashed
  • I've received my biometrics letter
  • and finally, I've completed my bometrics. smile.png

Sometimes I don't think that the right hand knows what the left hand is doing. Anywho, I didn't panic. I simply sent them a reply email stating that I was doing AOS and giving them the receipt numbers for my AOS package and dates for the cashed check as well as the completed biometrics. I would assume that silence is golden, but this is USCIS/State Department and for all I know they have already sent my paperwork on to the consulate. smile.png LOL.

This is a simple reminder to smile as this process progresses. No need to stress. Things will work out in God's time. Have faith and patience my friends.

Hello guys, I just received my NOA2 from Nebraska Service Center and the language on it is very confusing as USCIS continue with their mediocrity:

it states:

"The above petition (i-130) has been approved. The petition indicates that the person for whom you are petitioning is in the United States and will apply for adjustment of status. The evidence indicates that he or she is not eligible to file an adjustment of status applications. This determination is based on the information submitted with the petition and any relating files."

"Because the person for whom you are petitioning is not eligible to adjust, we have sent the approved petition to the Department of State National Visa Center (NVC), NVC processes all approved immigrant visa which consular post is the appropriate consulate to complete visa processing. NVC will then forward the approved petition to that consulate. This completes all USCIS action on this petition. If you have any questions about visa issuance, please contact NVC directly. Please allow 90 days before contacting the National Visa center regarding your petition. The NVC will communicate with the person for whom you are petitioning concerning further immigrant visa processing steps. "

This is very strange bc the beneficiary has a valid status in the United States.

@Bokar83, I understand that your petition was sent to NVC, that is why NVC contacted you.

Did your I-130 approval notice state why your 130 file was routed to NVC even you clearly checked the box that says the beneficiary will be adjusting in the US?

Hope to hear from you and anybody with a similar experience in F2A.

Hi. Yes. My approved i-130 stated the same thing, even though I had checked AOS on the form. I have contacted the NVC and everything seems to be in order. However, my status still hasn't moved from accepted for the i-485. That is my only worry. My biometric appointment date was the 28th.

Sorry for not responding sooner everybody. I have been offline for a few days.

Ok guys, I have a very very weird situation going on here:

Today is the day I was supposed to get my letter for my FP interview. I checked the mail in noticed there were 2 letters from USCIS.

The first one is addressed to me RE: my FP interview scheduled for Sept 29th 2013. So all good and normal with that.

The SECOND letter however, was addressed to my wife and a copy sent to our attorney. It is a pink letter with a scheduled appointment to a local USCIS office in Houston for her to show up with all our case file (proof of marriage and all supporting documents). The weird thing is that it asks for her to bring ME to the interview.

Now, the receipt number in the letter is from our I-130 so It's got nothing to do with our AOS. Now, if that interview is to see if they are gonna approve or deny my I-130 would that mean I can get my stamp on the passport that day???

We are so confused....does anyone know what the heck is going on???? helpsmilie.gif

Hey Bokar83 my guess will be that just like me, you did not include form I-20, 94 and copy of passport with visa with your I-130 application so USCIS thought that maybe the beneficiary entered the US uninspected and therefore will not be eligible to adjust in the US.

The reason I am saying so is bc I have spoken with another poster who included these things and their case was not sent to NVC.

I don't think you should worry about your case not moving yet, it is likely that NBC has not received your 130 case file from NVC. You may want to call NVC and double check that your case file has indeed been shipped back to USCIS at NBC.
