Received the RFE yellow letter today. Guess what? It says they can't process my 485 case because I didn't submit the evidence to show the 130 petitioner is US citizen @@. I filed F2A, my spouse is green card holder and everything stated clearly in my 130 petition with the copy of green card. I'll call USCIS to ask about this mistake tomorrow.

After readin Feelingood's posts a chill ran up my spine thinking that maybe they will do that to all of us saying we can't apply for AOS in the end, but that would make no sense. The law states we are able to do it. Just call them and I'm sure they'll notice it's a mistake.

Normally how long does it take for the I-130 to be approved after the case has been transferred to a local USCIS office? My PD is Feb 06 2013 and my case is with the local office from Aug 26 2013.

Sep 27, 2013: I-130 approved.

July 31 2013: I-485, I-765 and I-131 sent

Aug 01 2013: USCIS received AOS package

Aug 06 2013: NOA 1 received for AOS

Sep 09 2013: Status changed to Testing & Interview

Wow, scary....

I will bet this is clearly an error by some newbie working in the processing department. Once an AOS application is received, USCIS determines whether you are eligible to adjust or not.

If you are, they will cash your check and issue you a receipt notice. If you are not, they will instantly deny the application and your check will not be cashed.

Please keep us posted once you hear from them.....

Worst case, time to get congressmen and senators involved....

Weird... I don't think the information they provided is correct. I'm sorry but they must have mistaken your application. What did you check in Part 2 of form I-485, by the way? "A" or "H"? I checked "H" and clearly stated that "I-130 was pending and PD was current" and so far no problem, but I'm not sure that this would matter.

I actually got my expedited AP approved today. They also approved the EAD (which I had not requested to be expedited, but I guess it's because of the combo card). This means that you can definitely apply concurrently. Good luck and keep us informed!

Thanks for the info. I checked "Others" as well and wrote I-130 pending, PD current and LPR spouse. Hope there are no issues.
