When is IR1 vs CR1 decided?

Hi,

My husband and I are planning on sending in I-130 paperwork this week or next.

Some background:

- He is Chilean, I am Polish/USC

- Married since March 1, 2012

- Legal residents in the UK for almost 2 years (him through marriage to an EU citizen)

- Will be doing DCF in London

We are hoping to travel to the US sometime after March 1, 2014-end of May 2014. We had planned to travel then because it would be after we had been married 2 years and therefore would get IR1, not CR1 but I recently read on a forum that IR1 vs CR1 was determined when the visa was issued.

Can anyone confirm when IR1 vs CR1 is decided - is it at POE or visa interview at the consulate?

I tried searching the forums but I couldn't find the information.

If you have been married for less than two years when your foreign citizen spouse enters the United States on an immigrant visa, his or her permanent resident status is considered “conditional.” The immigrant visa is a conditional resident (CR) visa, not an immediate relative (IR) visa.

Sounds like POE to me.

It's at the POE. Earlier this month, my husband was told at POE that if he had waited until our 2 year anniversary to enter, he could've received the IR-1 (10 year GC).

August 2008 - met when we were both living in England

February 2009 - began dating

May 28, 2011 - got engaged

August 5, 2011 - got married (in England)

September 29, 2011 - moved to Mexico

VISA PROCESS:

December 3, 2012 - sent I-130 to Mexico City (DCF)

December 6, 2012 - I-130 approved

December 14, 2012 - NVC case number assigned and instruction letter sent from Juarez Consulate but we NEVER received it

March 4, 2013 - called to check about our case and received our NVC case number and Invoice number

March 9, 2013 - submitted DS-260 online

April 17, 2013 - interview date - visa approved!!!

July 11, 2013 - POE: entered US through Dallas, TX

July 22, 2013 - Social Security Card delivered

August 22, 2013 - Green Card delivered

Timeline after visa approval

Immigrant fee paid on ELIS - Jan 24th

POE - Jan 25th

Update on GC and SSN

(as of March 14th, 2014)

ELIS status - Closed (Card produced)

USCIS case check with receipt number (starts with IOE) - Card delivered in the mail

SSN - Received (Went to SSA location to apply for one)

N-400 Naturalization Process

N-400 package mailed in - Nov 7th

Payment posted on cc account - Nov 10th

NOA (hard copy) - Nov 14th

Biometrics - Dec 7th

The posters above are correct but if your second anniversary falls between the issuance of the visa and your POE it is important to draw the CBP officer's attention to the fact that you are now entitled to be admitted as an IR1. It does not always happen automatically.

Timeline

When is IR1 vs CR1 decided?

There are several decision points:

1. on I-130 submittal or

2. on Interview day or

3. on POE date.

for 2, must remind Consular Officer about the marriage date.

for 3, must remind CBP human about the marriage date and show marriage certificate, and not leave secondary inspection until the IR-1 designation is confirmed.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !
