i have sended my packet and i have recieved an RFE asking me for 2 things a proof of finalizing my divorce and proof of meeting within the 2 year period. ok my question is i never sended and intend to merry from me my friend said just write one and also send it with the RFE do anyone think its a good idea and if its a good idea to send it now should i write todays date or an earlier date because i sended the packet about a year ago

Yes, send a letter of intent if you didn't before, with today's date. Explain in it that you did not send one before but that your intent to get married did not change and is still strong.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

You sent your petition a year ago and got an RFE now? Something doesn't seem right about that.

Yes, send a letter of intent if you didn't before, with today's date. Explain in it that you did not send one before but that your intent to get married did not change and is still strong.

It's normal processing time for Yemen petitions - I am afraid. We are treated differently than everyone else.

I agree send in your own letter of intent to USCIS with the rest of your RFE package with today's date.

Their timeline says October, and I do not believe it is because of Yemen. They do not process the I-129F petitions based on what country the foreign fiance(e) is from. They are not 'Yemen petitions'. All petitions are from USC petitioners in the US. There were many people caught up in the backlog of the VSC, which is why they recently started transferring some of them out to the TSC to help get the petitions processed finally. People have been waiting 10+ months and they were definitely not all for fiance(e)'s from Yemen.

Getting an RFE is the perfect chance to include anything else you might have missed that needs to be in your file. Just be sure to provide exactly what the RFE is asking for first and foremost.

I was actually told initially that ALL petitions with Yemen beneficiaries are ON HOLD INDEFINITELY. This is because document verification is difficult in that country and USCIS sends civil documents included in the packet to the Embassy in Sanaa for verification before they will even approve the petition. There are many issues with the Embassy there and with USCIS's handling of cases. I-129F petitions actually get processed a lot faster than I-130's. Marriage based petitions can take 2-3 years in a holding pattern before approval.

My fienci wrote a letter of intent but on her letter it says that she will merry me within 90 days of her entering america and this is the acceptance of her and her parents. I sended the copy of it she didn't wrte the she is freely to merry me or of her entering America using k1 visa do anyone think I should have her type a new one and send it so I can send it with the RFE

Thank you for that clarification about the communication and documentation troubles between the embassy in Yemen and the USCIS. It sounds like those from Yemen get put in long AP like some of the other MENA countries. Though that still doesn't explain why others petitioning for someone from countries other than Yemen have had to, or are still waiting 10+ months for an approval of their I-129F.

It may not be absolutely necessary to add the K-1 part on the end of the statement of intent to marry within 90 days but the instructions do mention intent to marry within 90 days of entering as a K-1. If there is time to have her sign a new one and mail it to you before the RFE is due, then you might want to, just to make sure you cover all your bases to get an approval. If you have her do a new one, she should use the statement from the example here. It seems to work well.

I, (applicant’s or beneficiary’s name), do hereby state that I am legally able and willing to marry (petitioner’s or beneficiary’s name), and intend to do so within 90 days of my arrival into the US using the K-1 visa.
