Hi,

I need serious help and advice on this issue (a big problem).

My brother is the principal winner for Dv lottery 2013 and his appointment for an interview is scheduled in September

a month from now.

He just did medicals and currently waiting police records from Africa.

He reside in Tokyo Japan. with his family wife and 2 kids

9 years ago, he had appleid for a US visa back at home( Africa) using differents identity due to politcal

reasons, but he wasnt granted the Visa,and was fingerprinted with those names.

My questions and worries are now, are for his upcoming interview using his real identity,

- am wondering if his former prints will be detected at the embassy here in Japan since he took prints in another embassy in Africa?

- should he just be honest and tell them the truth incase they find out, when he does his biometrics on the interview day?

Incase he is safe and issued a visa here in Japan, will old his prints show up at th POE in America,because Homeland security runs a back ground check on their data

-Incase he is deneid a visa, will that affect his family (Japanese citizens) from ever travelling to the US?

as i understand japanese dont need visa to travel to the US and they are just beneficairies to the Dv lottery.

PLEASE URGENT ADIVISE NEEDED

finerprints are in a world wide database, they will be detected sooner of later and if he doesn't clear it first when it comes to light he and his family would be subject to losing any benfits they have gained. There is a place on the forms for "other names used" this is probabaly his only hope of clearing up this. It is usually reserved for woman that have married to report other names but it could help here. He will report the other name here and give the reason that he used other names.

This will not be over quickly. You will not enjoy this.

If principal winner is disqualified for any reason, his family won't be getting an immigrant visa either.

Japanese citizens would then probably have to update ESTA with visa denied (have you ever had a visa denied question) and see if ESTA comes back with approved or not response at that time.

Thank you guys for the incoming replies so far recieved.

i guess not much is left to be done or could change the nature of things at this stage other than to take a leap of faith and go for the interview

as scheduled.

WHO KNOWS ... MIRACLES DO EXIST.... lets wait and see the outcome

Que Sera Sera... What will, be will be.

As they say,Nothig good comes easy and there is always a price to be paid for anything one needs.

Its cost very expensive in Japan with a family of four to go through the whole process ( medicals fees ,Interview fees, travels expense, hotel accomodation

in Tokyo etc ) but he has to do that till the end.

I just hope the Almighty Lord will work it out positively.

He might be lucky and might get thru now but that does not mean that it will never be caught, even after he gets US citizenship and is found that he used false identity his citizenship can be revoked.

Something like this would catch up with him sooner or later best idea would be to be honest upfront and go from there.

since both fingerprint intakes were done with US DoS, Consular Services,

you can be certain that the data is shared, as it's the same computer db, network, regardless of location, worldwide.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

Is it a good idea to call KCC and informed them directly about this issue?

He thought of sending new forms D-230 but i guess that might take more time since his interveiw is in 3 weeks from today.

Why? The case is at the local embassy by now. He can fill out new DS-230 forms and bring those to his interview.

The forms DS 230 are only signed on the interview day before swearing to the oath , so i guess he should tell truth about

his former identity before the start of the interview.

It will be a tough situation but .... as everybody is opting for the truth to be told, i hope the CO can give him a chance.

A friend said that, it was better he says nothing to contradict the information on his forms and thats prints taken at local embassies are not often

verified with other prints in the data, fingerprints are only cross checked at the POE.

Is anyone aware of this ....? in that case, i suppose his prints will surely show up at the POE and he will have to battle out that with immigration at the POE in the US

There was a Nigerian tripped up by having more than one passport and it was caught in Nigeria so they check before the interview. One of the things that AP is about is checking for other/false identies. There is no real hope for it not to come up.

This will not be over quickly. You will not enjoy this.

If it comes up at POE it would be even worse, not having disclosed during the interview would mean he intentionally lied to CO during interview.

Which means a lifetime ban and would be returned back from POE.

What could be a possible answer to give or say

If asked why he didn't make mention of haven used other names in the past #2 and#37,

And one of the check box rules of seeking

having sought a visa by fraud or misrepresentation

Really? Tell the TRUTH.
