k2 visa for child

Timeline

Have been doing searches for K2 visas with no luck. When getting a K1 and she has a child does she need permission from the father of the child to get the visa and passport? if so what form do they need to sign?

I know here in the states you must have permision from both parents. Also I dont see on the i129f application space for the child, do you just fill out 2 of them and send the extra fee or what other docs are needed for this?

Their is no form per se for the permission from non-custodial parent because format may depend on the country of your fiancee. This however will be required to be provided at the consulate stage and is not required for the initial petition

I had a Court Order allowing me to bring my daughter with me, because her father would not agree, but the Court sided with me seeing as he hadn't had any contact with her for years. I think, though, that others were lucky enough to simply have a letter, signed by the non-custodial parent, giving their permission. I would imagine that this would have to be notarised or the signature witnessed.

Yes. :thumbs: My son's father doesn't have parental responsibility, but I still had to get a notarised letter from him giving his permission.

In my case if the father was not locatable and we could not produce a death certificate then a court order was required. Your best bet is to ask the Consulate what they need

The child will need "notarizado"permisson - in writing from the father EACH time the child leaves the Colombia, otherwise DAS will not allow the child to board the plane. (We had to do this for 15 years) If you think you will have trouble securing permission in writing I would suggest calling DAS and explaining the situation. You may look into notifying "BienEstar Familiar" in case the father decides to play hardball, or if you can not locate the father.

You can ask the Consulate what they recommend, but your problem is not with the US authorities when it comes to the child leaving Colombia, nor entering the US(providing she has a valid visa of course). The problem is with the Colombian authorities, specifically DAS (Departamento Administrativo de Sugurad). I never had any problems with US authorities with my stepdaughter. If she travelled, left Colombia, without her mother she would have to produce a letter from a NOTARIA from BOTH parents. When she travelled with her mother she had to produce a letter from the father only. To travel TO Colombia she needed permission from NEITHER parent.

If you can not secure permission from the father, assuming he is alive and uncooperative, BIEN ESTAR FAMILIAR, the Colombian child welfare/social workers will help you.

When your fiancee recvs packet #3 "Instruction Package" you must ensure there is a k2 application enclosed for the child. If not enclosed, call the consulate to request one.

I'm not sure if it was necessary but I also enclosed a pic of the child with my my I295F/G-325A package. Dont forget to a list the child on page 2 of the I295F form.

OF-167 -- information sheet about financial responsibility. You may also receive an I-134 Affidavit of Support form.

DS-230 or OF-230 Part 1 -- biographical data sheet.

DS-156 -- Nonimmigrant visa application form

DS-156K -- Nonimmigrant fiance(e) visa application

DS-157 -- Supplemental Nonimmigrant Visa Application (for all males between ages of 16 and 45)

You may, at this time, receive medical exam information, and a list of required immunizations.

DSL-1083 -- An information sheet about police certificates, military records and more.

In December, 2001, the State Department announced a change in the name of Packets 3 and 4, which were the instructions, forms and appointment information. They are now referred to as "Instruction Package" and "Appointment Package". Some of the forms are renamed slightly as well, so if the exact form numbers are different, just follow the instructions.

Sometimes, the Consulate may forget to send extra copies of these application forms for the children for whom a K2 visa is intended. If so, contact the Consulate to obtain the forms.

I did a fiance visa in the past with Colombia but withdrew it and it got approved anyways but never did the packet 3 since it was withdrawn. However there were no kids involved with that one. So this info really helps, i will keep you advised on the progress.

I don't know about Columbia, but for Thailand, there is no special permission required from the natural father for a child to leave the contry with the mother. In my case, the natural father is completely out of the picture, so there's no problem.
