I-765 Employment Authorization (OPT or H1-B )

Hi all,

My H1-B( work permit ) is approved for 3 years and will start this October 2013 . So my OPT is extended till Sept 30th September , 2013.

So while filling out I-765 form , What should be my current Immigration status ? OPT or H1-B

​There are questions I am confused about ?

11 )Have you ever applied for employment authorization from USCIS? ( I applied for my H1-B Visa this April 2013)

15) Current Immigration Status ? (OPT or H1-B )

16) Go to the " who may file form I-765 ?" section ??? Where do I see this section?

11. Yes, the EAD for your OPT. H1b doesn't use an EAD.

With EAD it is easier to look for jobs and I pay less taxes. With H1-B , If i go to India and come back , I would need stamping and that's another risk which I would prefer not to take. Is there any harm in applying for EAD? Most of the companies in US hire EAD GC candidate but they do not prefer H1-B. Also, I have decided to change job and move with my Fiancee so EAD will definitely help in faster looking for jobs.

Oh by what I said I mean, what are you applying for, or what status, qualifies you for an EAD? i.e. is this an EAD for OPT? or is it an EAD you're getting because you have I-485 pending?

Also , My h1-b ( work permit ) is approved . Do i need to attach a copy of my approved H1-B along with I-765 form?
