What possibly may of helped your situation is to have emailed or faxed the consulate a request to extend the validity date of the I-129F petition, along with updated 'Letters of Intent'. Not just postponing the interview date. They have the authority to extend the petition in 4 months increments.

If you have not recently visited your fiance or you have no intention of visiting your fiance anytime soon in the future, your only hope is to try to appeal your case with the consulate. You have not cured the condition in which your original petition was allegedly denied upon and any refiled petition will be denied because nothing has changed. Does that make sense?

"AUSSIEWENCH" is solid with her facts. If you were going to listen to anyone that's responded to your thread, including my earlier commentary, she would be my pick. And I am saying that with respect to all other responders. She's been giving good advice on this board for more than a year. And she's thourough. There are many others with the knowledge of experience and their own investigative skills. But you won't go wrong listening to the "AUSSIEWENCH". I hope that you can get things on track again.

It's not a lottery and we're not immigration attorneys. Everyone here has given you their best guess, because your situation is not usual.

You now have a selection of options to RESEARCH yourself further, so you can decide which route is best for you.

None of us is here to tell you what exactly to do in this situation and it's unfair of you to ask.

If you're uncomfortable doing the research and want a definitive answer, you can hire an immigration attorney for a consultation or your whole case or you can try your luck with an immigrant's assistance group like Catholic Charities.

While I love the Wench as much/more than many here, note that she gave a 'what you should've done'---you have to be ready to do a lot of reading to make sense of what you discover. There's no shame in hiring a pro if/when a situation gets 'unusual' as yours has.

personally i would go crazy if i can't go visit my gf and just slam her down on the back and have <censored> after every two-three months. she lives in Vermont and i live in NYC and the plane fair is like 200 dollars up and down each time but anyways three years is a damn long time i mean damn no sex in three years what's wrong with you all? :lol:

Um what about videos? which one works best? videos or still pics? I got lots of videos of my gf taking shower and walking with me in Burlington and while we were going to the city clerk's office to purchase the marriage license, it was all video-taped. :D
