C1D affect on K1 application?

Hi,

So I'm intending to file my i129f in November of this year to allow 5 months for the NOA2 which will allow me to schedule my interview at the embassy in London in June based on the subsequent 4 months validity.

This is because my fiance and I work on cruise ships throughout the year, and I do not get back to the UK to go for the interview until the end of May so my timing needs to be pretty good. He is an american citizen and I work on a C1D Crewmember's visa which is valid for 10 years. I will already be on the ship (ie in the US) by November when I file, will this have any effect on the status of my application?

I had heard from a friend that while she had only filed her i129f from australia, she entered the states on a visa waiver and when she got back her application had been cancelled?

Can anyone enlighten me on this or where to find the information?

You don't file the I-129F, the US Citizen petitioner does that. As far as the validity of the petition goes, do not worry about that, the Embassy has the ability to revalidate the petition if an interview has not yet taken place before the original expiration date (they do this routinely).

Do you have a plan if the NOA2 wait time goes back to 7-8 months? I explained to you before that all you have to do for London is take a notarized letter of intent from your American fiancé to the interview and all is fine if you are past your 4 month NOA2 expiration. Pretty easy. Easier than counting on any timing you have worked out in your head because there is potential for hold ups all along the way.

I've never heard of the situation you described about your friend.
