Filling up forms I-485 and I-130

Hi Everyone,

I am currently filling up forms I-485 and I-130. It is mostly done except for a few lines that I need clarified.

First, here are the pertinent facts to my circumstance, a brief history. My US visa was issued in 2008; under 'Visa Type/Class' it says: "R B1/B2". Used my visa a few months after it was approved. Then returned back to home country. After a few years, I met my then boyfriend (now husband), and in 2011 we got married in the US -- still on my tourist visa. Then I went back to home country, again. Now we are back in the US for good, in the next 4 years (we are in the Navy and will be stationed here).

My questions are:

On form I-130 --

under letter C., #2, what address should I put in? My address in home country or the address I have in the US?

under letter C., #9, it asks for SSN, of course I don't have one but I was able to procure an ITIN. Should I put "n/a" or the ITIN that was given to me?
under letter C., #14, the blocks provided for 'Arrival/Departure Record (I-94)' does not match the form I was given by the Immigration, how should I fill it up? Also, my I-94 does not have an expiration date; it is stamped the date I was admitted entry and the Immigration Officer scribbled B2. Is it okay to just put in the date my visit is supposed to expire as per my visa type?

On form I-485 --

under part I, still wondering what address to put in -- the US one or home country?

what should my 'Current USCIS Status' be?

December 2011: Got married in USA.
January 2012: Parted ways; The Hubb back to Japan (where he has been stationed since he got out of boot camp) and me, back to Cebu.
April 2012: Applied for Japanese tourist visa.
May 2012: Approved and subsequently flew to Japan to be with The Hubb.
July 2012: Applied for adjustment of status -- SOFA visa; Japan Immigration cancelled tourist visa and got a stamp of re-entry permit from US Naval Base.
September 2012: Vacationed in Cebu; flew back to Japan with nary a hitch.
April 2013: Flew to US (with B1/B2 visa), POE: Chicago, IL.
July 2013: Found out The Hubb will be stationed in the US for the next 4 years.
October 2013: Filled I-130 and I-485 concurrently, with I-765.
October 2013: NOA1
October 2013: Biometrics and fingerprinting appointment received.
November 2013: Biometrics and fingerprinting completed.
November 2013: Received email that I-485 is now on 'Testing and Interview' phase.
December 2013: Received EAD.
December 2013: Interview appointment set for January.
January 2014: Approved.
January 2014: Received Green Card in the mail.

Good questions, I too am waiting for an answers to these questions .idea9dv.gif Tourist visa should be for 6 months. When you file the I-485, I am led to believe you can stay over the 6 months until process is completed.

That's what I thought too, Tradewind. So I am going to go ahead and write down the date 6 months after the date stamped on my I-94.

I understand that you can stay on a tourist visa once you have filed the I-485. I plan to file the 1-130 and file the I 485 after it is approved. What I am worried about for my wife is that they won't approve the I-130 before the 6 months run out. Then what ?? Hopefully someone can answer that question for me.

You can look up your I-94 online now. Go to I-94 retrieval on google search and you will find the new website to retrieve your information. I know you can retrieve your I-94 number but other than that put your info in and see if you can.

They will not be giving out I-94's too much anymore as they are going electronic...

I would really like to know whether to put my wifes Colombia address or the address in the USA where I am domiciled.....She is here on a B2 so I guess my address is not really her address unless she is approved. I think I will give my wife's address in Colombia then put the (in care of) my address in USA.

I think on the I-130 you should put your address in the Phillipines, just my opinion

On the I-485 you can put the (in care of). Hopefully someone on this forum with experience will help us.

Filing an I-130 by itself does nothing for someone already present in the US. It does not protect their status in any way, or prevent them from going out of status. Whilst you certainly could file the I-130 first and then the I-485 down the line, there is absolutely no point in doing so.

Only filing an I-485 grants someone legal presence which persists until their application is finally adjudicated.
