Hi,

My wife's I 130 was approved today :thumbs:

We applied on 9/25 and thankfully got approved on time.

I am leaving US next week to be with her for a month. If NVC sends me the AOS notice (apparently that can be checked by calling them) I will use James's shortcut to send the payment.

Now my concern is that I may not be able to send in completed I 864 until after mid-January. So that bring up two questions:

1. How long do they usually take in generating I864 after receiving AOS payment?

2. Is there any timelimit given by NVC for replying on I864 forms?

Just checked my paperwork. Regardless of whether it is the I-1864 or something else, NVC gives you 12 months to respond.

From my timeline in my profile

12-21-2005 AOS Bill entered into system

12-27-2005 I-864 generated by NVC

01-03-2006 I-864 received USC spouse

02-17-2006 Returned completed I-864

Ours wasn't too big of a break between hubby receiving the I-864 and NVC receiving it but we still waited. As long as the last contact that NVC receives from you is within 12 months, your case remains open with them.

The NVC may not be sending you an AOS notice. Because the USCIS may not be sending your approved I-130 petition to the NVC, they may keep it in anticipation that your wife will apply for a K3 visa and adjust status.

This policy is rather new, so anecdotal evidence is limited - please do let us know if your approved I-130 does get sent to the NVC.

COngratulations on the approval. Now answers:

1. within 1-2 week after they receive the AOS payment, NVC generates the I-864 packet.

2. NVC gives 12 months time limit for I-864 to be returned to them.

I-130 Timeline with USCIS:

It took 92 days for I-130 to get approved from the filing date

NVC Process of I-130:

It took 78 days to complete the NVC process

Interview Process at The U.S. Embassy

Interview took 223 days from the I-130 filing date. Immigrant Visa was issued right after the interview
