DUI and Minor Charges Affect for Visa?

I have a job offer in US and now need to get a visa.

I have DUI from 2009 (fine of $1000) and Mischief of Data / Theft Under $5000 / Destruction of Information (for an ipad that I found and couldn't return since I was out of town) - but due to a diversion program everything should be "cleared"

Would I have a hard time getting a work visa because of these? or even travelling to the states?

Thanks

Those are not cleared from your records for immigration purposes. You ae asked if you ever have been arrested, convicted of crimes. Theft is a bad mark on moral character so you may run into more problems than you may expect , but you may get by.

This will not be over quickly. You will not enjoy this.

You have to be sponsored by a Company anyway.

Discuss it with the Lawyer handling the visa application on the Companies behalf.

“If you know the enemy and know yourself, you need not fear the result of a hundred battles. If you know yourself but not the enemy, for every victory gained you will also suffer a defeat. If you know neither the enemy nor yourself, you will succumb in every battle.”

I'm sorry everything is not "Cleared"... As the above members stated: You need help and it maynot be to any avail to enter the US. The DUI can be overlooked depending on the cirumstances. But, the Theft, tampering, destruction of information for the Ipad you found and Maliciously tried to conceal is not forgiveable to Homeland Security. A diversion is for the DUI. You had a day in Court and were Convicted. You violated the Moral Turpitude Law of Homeland Security of theft.. I'm not trying to down or be-little you. Consult with an Attourney and be Up-Front with whoever who wants to Sponsor your Work Visa

To be clear Diversion was for both DUI and other charges.

As far as I know - I am talking to a lawyer - I am not convicted for anything.

"No, it is NOT a conviction. Although it will show on the customs/police system, it shows up as a notation says 'charged with mischief/theft on date X, charges withdrawn on date Y'. This is in no way tantamount to a criminal conviction / record."

I will talk to the lawyer on companies behalf. But before that is there anything else I could do?
Does the Waiver Program help at all?

The best you can do and the only thing you should do is follow the advice of your counsel.

Good luck!

I doubt you would qualify for ESTA, most likely you would need A B with a waiver.
