I ll make it quick for now..

It doesnt look like I am gonna marry my fiance...

My mother lives here in US... can she file for me... so I dont have to leave ? what can I do? :help:

Aug 2001- met in highschool in US

Feb 15 2006- sent I 129

Feb 17 2006- NOA1

Feb 23 2006- *touched*

April 1 2006- still waiting =(

July 10 2006- touched!!

July 11 2006- touched again!!!

July 24 2006- touched (RFE in email)

Aug. 7 2006- RFE in mail

Aug 15 2006- sent back RFE (the wait begins again)

Aug 26 2006- touched (RFE recieved)

Aug 28 2006- APPROVED!!!!!- after 192 days~!

Sep 3 2006- get NOA2 in snail mail

Sep 13 2006-NVC recieves case!!!

Sep 18 2006- NVC sents case to Embassy!!

Sep 21 2006- Embassy recieves!

Sep 27 2006- Embassy send interview packet!!

Nov 9 2006- Medical completed

Nov 20 2006- Interview APPROVED

Nov 22 2006- picking up my VISA

NOV 23 2006- leaving for ATLANTA

So, you travelled over on the K-1 and now don't want to leave, but aren't going to marry your fiance? Is that right?

I will make it quick...Looks like you have been in the country for a week. If you do not marry your fiance you will have to leave.

Your mother can possibly file for you but will not likely be successful if you have an overstay but there is not enough info about you or your case do say.

Actually, I remember you now. Your mother applied for a visa for you, then you applied for a K-1 at the same time...that is you isn't it? So, you now want your mother to re-apply for another visa now...

Cos all this applying for different visas is going to look VERY dodgy IMO.

Julie, you know the drill...

If you entered as a K-1, your only hope on this entry is marriage to the original sponsor only.

You don't give your mother's status in the US. You don't give your age. You know those are 2 of the important factors to determine what's available to you.

Time to start researching, but I'd say that your odds are not very good for a quick way to live in the US.

One has to ask was this K1 just a quick way to get here??? if as your timeline shows you have known your fiance since high school then what has changed in a week of you being here....

If I were you I would book your flight back to where ever it was you came from and await the outcome of the petition your mother filed...

Yah. The OP knew her fiance for 5 years and just now, after arriving in the US on a K1, figured out she doesn't want to marry him??? :oops:

(d) The Attorney General may not adjust, under subsection (a), the status of an alien lawfully admitted to the United States for permanent residence on a conditional basis under section 216. The Attorney General may not adjust, under subsection (a), the status of a nonimmigrant alien described in section 101(a)(15)(K) 2aa/ except to that of an alien lawfully admitted to the United States on a conditional basis under section 216 as a result of the marriage of the nonimmigrant (or, in the case of a minor child, the parent) to the citizen who filed the petition to accord that alien's nonimmigrant status under section 101(a)(15)(K).

In other words, if you chase down all of the paragraph references, it means that if you came in on a K-1, the only option to adjust status is as a result of marriage to the original petitioner. If you don't marry the original petitioner, then nobody else can help you adjust status, your status will end, and you must leave.

:whistle: You petitioned several times to come here for schooling, then for a fiancee visa, then your mother applied for a visa for you, sheesh you really want to be in the states huh? IMO this is one more reason immigration takes so damn long. I would hate to think how much time has been spent sorting through your various visa applications, holding up someone else that wants to be with their spouse/fiancee.

lots of judgement here..... I want to marry my fiance more than anything... its him who decided not to... my mom is here and she has a green card...i lived in US since i was 16...so all my close friends and relatives are here.... i dont have anything or anyone back home... i am 21 now...

anyways.. i am not a bad person.. i just wanted some advise...but i guess not..thanks anyway

I will go back to my original post.

You cannot adjust status from the K-1 without marrying the petitioner. That is clear.

You cannot stay beyond the 90 days if you do not marry. That is clear.

Your mother may be able to petition for you, but that will take time. (ie.. more than 90 days)

If you over stay your current visa you mother's petition will unlikely be unsuccessful.

It appears your choices are limited. You may want to seek advice from a immigration attorney rather than a public forum so you understand what your options truly are....

None of us are saying you are a bad person. It is just that you don't really seem to know what you are doing to be honest.

When you were over there studying, why didn't you apply for residency then along side your mother? Your story (or what we can gather from it) is very truncated and makes little sense.

What I, personally, get from your posts is a burning desire to live in the USA. How do you think the immigration service will react when they see all these applications?

With regards to the K-1. There is no way around it. You will have to go home within the 90 days.
