Hello

So I heard about this new law that's only lasting from aug 1 to aug 15. That a US citizen can petition for his/her silbling and the whole process will be completed within one year. I have done research about this and haven't found much on it, so I will like to know if this is true???

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Hello

It's probably F2A category being current which has absolutely nothing to do with siblings.

This is true, I petitioned for my stepdaughter at the same time as my wife, at our AOS, somehow her I-130 from me was "misplace". I didn't think it was necessary to bring my duplicate applications in. But got it to them the very next day. Wife's green card came in two weeks, later, we didn't get her daughters conditional green card in some 45 days later, and was also dated 45 days later.

But we were lucky, met others on this board that received theirs over 90 days later and had to file and pay for a completely new I-751 for that child. Plus all that evidence over again.

Also if our AOS only took 12 months instead of 13 months, my stepdaughter would have been under 18 when my wife received her US citizenship. No amount of begging would change this, 18 is 18 years old. So she had to wait an extra two years with another 1,350 miles of driving and additional fees. Can only wonder if they do this to get more fees.

This is more of what you can expect from dealing with the USCIS!

If somebody is telling you 'give us X amount of money and we'll get you a visa in a year, but you have to do it RIGHT NOW' then it's a scam... there are plenty of people trying to prey on would-be immigrants, especially ones who don't know their rights or speak English well.

Karen - Melbourne, Australia/John - Florida, USA

- Proposal (20 August 2000) to marriage (19 December 2004) - 4 years, 3 months, 25 days (1,578 days)

STAGE 1 - Applying for K1 (15 September 2003) to K1 Approval (13 July 2004) - 9 months, 29 days (303 days)

STAGE 2A - Arriving in US (4 Nov 2004) to AOS Application (16 April 2005) - 5 months, 13 days (164 days)

STAGE 2B - Applying for AOS to GC Approval - 9 months, 4 days (279 days)

STAGE 3 - Lifting Conditions. Filing (19 Dec 2007) to Approval (December 11 2008)

STAGE 4 - CITIZENSHIP (filing under 5-year rule - residency start date on green card Jan 11th, 2006)

*N400 filed December 15, 2011

*Interview March 12, 2012

*Oath Ceremony March 23, 2012.

In our case petitioning for an unmarried son over 21 with an I-130, 33 months was just about right with the California Service center. Only evidence we had to send in, was my wife's prior marriage certificate, her divorce papers, current marriage certificate, copy of her US citizenship certificate, and a translated copy of her son's birth certificate.

The former is a paper trail proving that is her son since their last names are different. Never a request was made for additional evidence, and after about 2 1/2 years, we received an I-793c from the USCIS that her petition was approved, then transferred to the NVC for processing.

That was about five years ago, still waiting. A child under 21 and single, should go must faster. And either the step parent or biological parent can petition. Only done at the Vermont office, average time is 7.4 months, but again only the USCIS, still shifted to the NVC for further processing.

Controlled by the executive branch, and now would help if you child is from the Middle East or Africa. And they do have their limits for so many visas per year.
