K1 visa and apartment lease

I searched around and couldn't find what I was looking for.

My fiancée will be moving here (hopefully next month) on a K1 visa. I live in a nice apartment building that requires access key to get around the building (to gym, pool, etc) you are basically trapped inside the apartment without an access key and they only give you one access key per person on the lease. So, I want to add my fiancée to the lease as soon as she gets here.

All I could find in the search was some people were able to do this, but it wasn't clear if they did this after they were married or before. I know it's not an issue to add someone to my lease. I ask before I signed this lease a few months ago and they said it was no issue. I didn't ask about non us citizen on a 3 month visa getting added.

My question is what documents are required by law for a landlord to rent to a non US citizen? Is a US Visa and foreign passport enough? Or will she need SSN too? Are there any laws about this stuff? I have a friend that is an apartment manager and she told me they might try to charge a one month deposit to add her, but I already paid a one month deposit when I moved in. I know they will charge an application fee which is like $300 I think, but is it legal for them to charge other fees for immigrants? And I think it's $100 for the access key.

I sent them an email and should get a response tomorrow, but I wanted to see if anyone else has experience with adding their fiancé/e as soon as they moved here (before SSN, AOS, EAD, etc).

My plan is to have her scan the visa and passport and ill give that to the apartment to add her, since the lease is digitally signed from their web site, so they would give me the access key before she arrives.

I live in a very similar complex (key card, pool, gym,etc.). It's a major complex with over 300 apartments and all they require is a copy of his visa & a fee of $200 to add a someone to thy lease. They know the situation and don't require a SSN or anything else. I hope that helps!

Oh yeah, and they said I could add him whenever to the lease (before or after marriage).

There are no laws about it. Only the preference of the place.

My apartment complex wanted my SSN so they could run a background check. They tried with my passport number but weren't sure how to do it. But your fiancee can get an SSN when she gets to the USA, you don't need to wait for that.

I am still waiting on my SSN and I applied in April. However, my husband and I just signed up for a lease and I just needed a copy of my passport. I live in Maryland and my apartment building is pretty strict with background checks and criminal checks but they only needed my passport and it was fine.

Thanks guys. I still haven't heard from my apartment. They usually respond to my emails in 1 day. I'm going to go talk to them when I pay rent tomorrow.

But, based on what everyone is saying we shouldn't have any issues with just her passport and visa!
