Hi Friends,

We already have a joint account opened. Having my fiancee name on my Leasing agreement is not possible. Also , both of use different phone connection, so we can not have the same phone bill and neither insurance bill. What else can we do ? We don't stay in the city . I am sure we would need more evidence when we go for the interview.

All suggestions are highly appreciated.

My / our situation is very similar.

I don't think there is a good or bad answer to that. if immigration question that, just explain why you keep the arrangement you have and indicate when you expect it to change.

Housing: cannot add another person to the lease, or roommates not OK with that, or a pet friendly rental, or cannot break a lease, proximity to work or school. Then say when do you expect it to change, ie. you are going to stay there until the lease is over, maybe the price is lower than at other places now, or one of you may be changing jobs soon which would require both of you to move so in the end that's a reason to let the things play out first.

Insurance: is one of you on your parents' car insurance? If we were to get onto the same insurance, it would double due to age and tickets. It does not make sense to spend more, especially if trying to save up for a place of our own.

Phone service: are you under contract? See how much you would have to pay in early termination fees? We went pre-paid at diferent times with different carriers due to timing of our contracts expiring. The bottom line is - we were saving money.

So whatever the situation is, just think of the reasons why it makes sense to you, even if it doesn't make sense to someone else.

Why don't you live together? When will you live together?

We will registered our marriage this 5th August. We got engaged last 21st July. After getting our marriage registered, we are planning to go to India and get married there in front of my parents so unless and until we get married in India we won't stay together. Also, I have signed a lease till Dec 2013 and she has a good job in Pittsburgh so we are planning to move together next year Jan 2014. So thats the plan for now. Now to explain this to USCIS is a hell lot of work.

That makes it appear as if you believe you are not really getting married, and you will not act as though you are married, yet you want a benefit for being married. You shouldn't apply for AOS until after you are married and acting like a married couple, not just "registered marriage" as you put it.

Well, there are lot of complications which can not be explained. We have to go to India and I need atleast ADP otherwise there is a high risk of me not returning back. Though I have a valid work permit but still I have to go to embassy for stamping and what If i get denied so I don't want to take chances. Filing AOS, I will at least get ADP if not GC. I am really not worried about GC since I have a valid work permit for 3 years from now . Only thing I am worried about is getting married back in India. My family is eagerly waiting for two of us to come there. This is the case with most of us immigrants here and I really don't think we are doing anything illegal here.

You are getting "pretend married" so you can get an immigration benefit. You say yourself that you will not live together after marriage because you won't believe yourself to be really married. That is fraud: a fake marriage for immigration benefits.

Harpa Timsah is just stating the facts of U.S. Immigration. When you are applying for immigration benefits for the U.S.A., you must be abiding by the expectations of the U.S. government, that is all. You are trying to follow two different societal expectations. Nothing wrong with that. It is the life of many people here from two cultures. Thanks. I already know about all these frauds and I am not concerned because my marriage is totally legal. Its not just me, I know 5 of my friends who were in the same boat and they got their GC approved. Harpa's statement "You are getting "pretend married" so you can get an immigration benefit. " is totally unacceptable. My only concern is too see my parents with my wife. I really appreciate you guys telling me about these frauds marriage but I am completely aware of it. Thanks again.

It's not that we are trying to tell you about fraud cases or saying you have a fraud case. What we are saying is that you have to follow the laws of this country if you want to have the benefits. It doesn't matter that you say or know your marriage is legit, it is what the U.S. government will believe. Because they have so many fraud cases, they need you to prove your case, for them to approve it. Perhaps if your friends were all in the same boat and were approved, you should ask them then.

OP: for religious purposes we dd not live together with my husband either....indeed, we did not live together even after (school issue) and still don't. Everything went fine, and was approved on the spot within 10 minutes, and our whole AOS process was 3 months. Just have other evidences...although I think the PGE bills you can put together under both of your names (you don't need to be married for that) as well as if you could change your rental lease that would be great. Other than that, have tons of photos...and include affidavits who prove that your marriage/relationship is legit. Good luck!
