Where is your mother? Is she in Manila? Is your sister married?

If you are qualified under the statutes of the Child Status Protection Act you can try and invoke that law in the Consular processing. At this time, CSPA is still under review before the Supreme Court, the government contested the 9th Circuit Court of Appeals intrepretation En Banc, the Class Action.

Worse case scenario, Consulate will not allow you to retain your derivative status of your mother's petition as you aged out, because they already deemed you ineligible in the first place, I am sure your name isn't even listed on the correspondence from NVC.

If you are single, never married in the Philippines you should be able to be included on or after your mother's visa approval by filing another petition or I-130 on your behalf with a request to AUTOMATICALLY CONVERT the petition and RETAIN the ORIGINAL priority date upon receipt of the original petition that was filed on your mother's behalf by your grandparent. Apparently there is no current guideline or cable on the correct and reasonable interpretation of Section 203 (h)(3) of the Act with respect to the new ruling by the 9th Circuit Court of Appeals. I know this for a fact as I fought for my own rights in accordance with the law of course with the help of an attorney -- 5 yrs ago.

USCIS Director requested for 2nd interview and biometrics (after I sent tons of inquiries to the US Senators Barack Obama and Richard Durbin representing Illinois)

(CSPA decisions and case laws with BIA, Federal Courts and Court of Appeals for the 5th and 9th Circuits do not require that petitioners on later filed F2B petitions be the same as the beneficiary of the original petition, in my case dad was the beneficiary of an F4, but USCIS stance on conversion is that it does not apply to other immigration petitions except F2A and it should not be considered automatic in nature, therefore filing is necessary). A new F2B petition to the derivative beneficiary of the original petition would not have been necessary as afforded by the Act, but the USCIS does not conform to its automatic conversion clause as was on the Act.

(without 2nd interview as originally requested on CIS letter when decided to reopen the case). {Approved AOS based on a hard fought CSPA Automatic Conversion of my F4 derivative status to F2B and Retention of dad's Priority Date of 1982 (therefore making the F2B petition current having retained dad's PD). Law that the government decided to ignore for more than a decade now since the Act was enacted in 2001 signed by President Bush. (The lawyer who represented my case before the District Office Director in Chicago was from the same law firm in Los Angeles who sued the government, in a class action, due to its restrictive interpretation of CSPA denying benefits to those who are otherwise beneficiary of the law, those children of intending immigrants who aged out due to no fault of their own. The law firm was successful in overturning Federal Court ruling in Los Angeles when it appealed the class action to the 9th Circuit Court of Appeals, En Banc decision.) 1. When your mother was petitioned -- Priority Date and Classification (F3?)

2. How long was the petition pending? from the time na nai-filed sa USCIS until the time na ma-approve.

3. Your AGE now.

Confused ako sa reply mo, May 2013 naging available ang visa or yun ang approval date na nakalagay sa petition? Kasi meron tinatawag na priority date, ung filing date, meron naman tinatawag na approval date, un naman ang date kung kailan na-approve ang petition. Iba pa rin ang date kung kailan naging available ang visa. I think you are mistaken sa dates, please check the paperwork again.

Parent mo was petitioned under F3, or ibang category? As of August 2013 ang pina-process sa Philippines ay Dec 1992 pa rin if Family Based 3rd Preference. I assumed kasi na married ang mother mo nung nagsubmit ng petition ang grandparent mo. Unless I have all other info, hindi kita mabigyan ng additional advice.

DS-230 Form Parts I and II will have to be sent to the US Embassy, you are doing a consular processing. Once the US Embassy sends you a letter na pwede na i-process yung petition, sa Embassy na dapat i-file lahat ng documentations. Usually meron nakalagay sa packet kung san dapat i-send ang papeles. To my knowledge, ang DS Forms are sent to the Embassy.

After paying the Immigrant Visa fee of $230 your MOM can submit her DS-230 and original civil documents directly to NVC. Don't forget to attach the corresponding cover sheet. She can use FedEx, DHL, LBC or 2GO couriers.

In order to become a derivative, your mom has to inform NVC that you exist. When she sends her DS-230 she can mail-in a separate letter stating that you (as her child) should be added in her F2B petition. Attach a photocopy of your NSO birth certificate.

Wait for further instructions from NVC because they will need to review your mom's case to determine if you are qualified to be a derivative and generate a separate Immigrant Visa Fee Invoice for you.

While waiting, go apply for a passport.

F2B is a family based classification for unmarried son or daughter of a permanent resident, however, once the permanent resident petitioner becomes naturalized citizen, the new citizen can opt out to automatically convert the petition and keep the priority date of the original F2B. Assuming your mother is and was unmarried, then she would fall into that category, F2B. BUT, if your mother was petitioned by your grandparent, and your mother was at that time married, your grandparent must have been a US citizen at the time of filing. This is pertinent to ensure the correct classification and to further provide you advice on how to best approach the case, especially that you might be eligible to keep your derivative status under your mother's petition by virtue of CSPA of 2001.

NVC in the instant case will remove your name on the list of derivative status at their determination of your age. You are now 24, basically over 21 years old, you are deemed ineligible for CSPA unless: a) Your age will be below 21 if after the calculation set forth on Section 203 (h) (1) of the act. Additionally, Patriot Act provides 45 days to be subtracted from your CSPA age. Like I said before, I am not too sure how the process works at the Consular office/Embassy. But I am certainly able to help you figure out whether or not you are eligible under CSPA now that your turned 24. Let me know.

One additional thing, if your name was no longer on the list of derivatives on the correspondence your mother is receiving from NVC/Embassy, I would say then you should not pay for the Visa Fee Bill for yourself, they won't include you on the petition, but you may write a correspondence requesting a review of your status invoking CSPA.

02/19/2008 - USCIS received re-filed Motion to Reconsider with a fee of $585. Motion to Reconsider was later transferred to the Administrative Appeals Unit (AAU) in Chicago, IL.

07/28/2008 - Motion to Reconsider Denial of Adjustment on Form I-290B was reconsidered. USCIS Director in Chicago in its own motion submitted a Motion to Reopen, to reopen the case in its entirety. USCIS Director requested for 2nd interview and biometrics (after I sent tons of inquiries to the US Senators Barack Obama and Richard Durbin representing Illinois)

08/02/2008 - 2nd Biometrics Appointment

08/18/2008 - Dad filed another F2B petition requesting F2B conversion from F4 under CSPA and retention of his priority date of 1982. (CSPA decisions and case laws with BIA, Federal Courts and Court of Appeals for the 5th and 9th Circuits do not require that petitioners on later filed F2B petitions be the same as the beneficiary of the original petition, in my case dad was the beneficiary of an F4, but USCIS stance on conversion is that it does not apply to other immigration petitions except F2A and it should not be considered automatic in nature, therefore filing is necessary). A new F2B petition to the derivative beneficiary of the original petition would not have been necessary as afforded by the Act, but the USCIS does not conform to its automatic conversion clause as was on the Act.

09/05/2008 - Email Notice on Adjustment of Status "APPROVAL." (without 2nd interview as originally requested on CIS letter when decided to reopen the case). {Approved AOS based on a hard fought CSPA Automatic Conversion of my F4 derivative status to F2B and Retention of dad's Priority Date of 1982 (therefore making the F2B petition current having retained dad's PD). Law that the government decided to ignore for more than a decade now since the Act was enacted in 2001 signed by President Bush. (The lawyer who represented my case before the District Office Director in Chicago was from the same law firm in Los Angeles who sued the government, in a class action, due to its restrictive interpretation of CSPA denying benefits to those who are otherwise beneficiary of the law, those children of intending immigrants who aged out due to no fault of their own. The law firm was successful in overturning Federal Court ruling in Los Angeles when it appealed the class action to the 9th Circuit Court of Appeals, En Banc decision.) The government then appealed the decision En Banc of the 9th Circuit Court of Appeals (which basically entitled "aged outs", or those derivative beneficiariess of any family based, employment based, diversity visa categories, who turned over 21 yrs of age, to join their parents upon receiving permanent residency status) to the Supreme Court, conjoined Federal Courts decisions out of the 2nd and 5th Circuit Courts of Appeals. PENDING before the Supreme Court, anticipating decision or ruling in 2014.}

HELLLLLLPPPP CSPA-AGING OUT??? To visajourney people, Im so sorry if i posted here. Iam a newbie here, don't know how to post thats why I replied to this topic. Iam very concern and worried about my case . I think its very sensitive. I don't know if Iam still be covered by CSPA.

Here's my info:

-My mother (LPR) filed a petition on me ( I was below 21 years old that time)

-BIRTHDAY: November 29, 1990-PRIORITY DATE: October 5, 2011

-APPROVAL DATE (by USCIS): June 20, 2013-I've paid all fees, AOS and IV fees.

-NVC CASE Completed on November 29, 2013 (however I received a checklist instructing me to bring AOS on the interview and that would be less than a week now)

-VISA BULLETIN-case become current I think in July up to September. Iam very sad because its like we're wasting time and effort here. So please give me some advice on what to do and please help me understand if iam still eligible for CSPA. All help is highly appreciated...
