Hello all,

Here's my timeline:

  • 01/10: H1B
  • 04/13: Married to US citizen
  • 07/13: Submitted papers for Marriage-based green card (I-130/I-485/AP/EAD)
  • 07/13: received notifications (I-797C) from USCIS for all applications right after.

Now here's the problem/question:

I got laid off today, hence my H1B is terminated.

What's my status now? "I-485 pending" or what?

Am I legal to stay in the US?

Thanks for help

You ARE legal but out of status. You cannot work or leave the country. You need to wait for your AOS approval. You will accrue over-stay but it will be forgiven once you get a green card through marriage to US Citizen automatically. Just don't leave the country and wait for approval.

Do exactly what "san diego" says- wait for your AOS process to be over with and to get your green card and dont leave the US.

Im in the same boat!..overstay is forgiven since married to an USC

Good luck
