I-134 Co-sponsor proof of income. (merged).

Hi all,

I have been incredibly busy as of late, and we just received our letter notifying us of our interview date two days ago... for our interview in two days. I was hoping to have a little more time. Anyway, I stupidly forgot to address the I-134 Affadavit of Support issue. I am a student, my father is a doctor who makes a 6-figure yearly income. I have filled out my form and have put $0 as my income and have provided an acceptance letter from my school showing that I am indeed a student.

My father will fill out his form, but due to the last-minute nature of this issue, he is going to get it notarized and have it faxed over to my fiancée, who is in the UK. Along with the form, he is going to fax several of his most recent checks.

Now, I have a few questions...

1) What are the chances that the faxed copies will be rejected?

2) Given my father's yearly income, are recent paychecks sufficient to show that he has adequate income to support us?

3) Is there anything immediately retrievable that my father can fax that could prove his income/employment? Tax returns / letters would take a few days.

4) If they find the documents invalid, but believe in our relationship, would these be grounds for denial, or would they allow us to provide further documentation?

I know this is all very last-minute, and I'm kicking myself for not addressing it way, way sooner. In any case, thanks for your replies.

If Your father is self-employed, then his 2012 tax return is the best proof. I don't know what you mean by checks? Does he get a salary paid each month?

You've got a couple of issues. In order for your fiancé to even get that interview date, he had to send back the form DS-2001 where he signed his name to--

I attest that I have all of the documents specified in the Instructions for Visa Applicants and other instructions, which are applicable in my case, and I am prepared for immigrant visa interview.

Well that was false if he didn't have the I-134 in hand.

Also an issue is showing up without a properly signed I-134 and proof of income.

They will tell him to send the proper documentation and they will review it and issue the visa after that. A courier will collect the documents and his passport, deliver to the embassy, and return the passport and visa,

Has he paid the visa fee in advance?

It's pretty unusual to get an interview letter with four days advance notice.

1) Read http://www.uscis.gov/files/form/i-134instr.pdf and look under Supporting Evidence. It does not state anything about originals but says copies, so I would assume this is ok. However you may also want to check the UK embassy's website (http://london.usembassy.gov/application_documents.html).

2) You will need to include recent paychecks either way, at least 2.

3) If he has his tax returns those will work, if not you'll need the transcripts (http://www.irs.gov/Individuals/Order-a-Transcript) which take about a week. You'll need the letter from the employer.

4) This one I am not sure about, but they could request more evidence and then you will have a shot at a second interview.

You may also want to call and reschedule the interview.

Ugh. This is what the DS-2001 is for. That was a sworn declaration that you had all your documents in order, including this one.

Anyhow.

Your dad may be able to overnight this stuff yo you with FedEx. I don't believe anything needs to be notarized.

London has a reasonably relaxed attitude to the I-134. They want to see the I-134 with wet signature. Then they want tax returns, or a statement of work letter + pay stubs.
