Travel outside US after we got married

Timeline

I'm a fiance of a US Navy who's currently stationed in Japan. We will get married in states with K1 visa (we are actually still in the process). My question is after marriage while waiting for AOS, he will need to go back to Japan after a month and I will be left alone in the US of course I want to follow him in Japan and I have to be there for him. Can I leave US while AOS is on process? Any advice is greatly appreciated.

12/04/2013 - I-485 Family-based Card in production (a.m.) then went to Decision (p.m.) - NO interview

12/09/2013 - Green Card was mailed!

12/11/2013 - GC received! 2 months and 1 day from the NOA1

From what I understand, you will still be subject to the visa waiver laws pertaining to your country. And, of course, you will need advance parole to get back in the US prior to receiving your green card.

You will need to apply for AOS and AP and get your AP approved and in your hand before you can travel. AP takes 3 months to be approved.

You will need to wait until you at least have AP, which takes 2-3 months. You can possibly get it expedited based on military deployment. Your local base office should also be able to help with travel permission to whichever country. Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

I think if im not mistaken you can follow your husband after marriage using his PCS (Permanent Duty Station) orders, or to modify his orders as accompanied tour in Japan , make sure he request a command sponsor for you and update his page 2.

Oh she can leave the USA, it's getting back in that's the trouble without advance parole. I suggest HIGHLY making sure you have your AP before you leave the USA or else you will find yourself likely doing a spousal visa vs finishing your AOS.

1st you will need to apply for Advance Parole (free with your file your I-485), 2-3 months to arrive like others said. My wife got hers two months after filing AOS.

Next. Can you, a Philippine citizen, travel to Japan without a visa? I don't know which countries the Philippines has agreements with.

would it be possible to marry in japan and stay there in japan, attached to his PCS?

If so, i'd suggest that route instead of the K-1, and then file an I-130 to the lockbox in Chicago.

I have been US Military since 1982 and did the K-1 Visa last year and know both systems well. Your husband was sent to Japan as a Single man on orders without a wife and he will be returning on those same orders. Yes you will have to stay behind until AP or GC is complete. Being Military does NOT trump USCIS. Your husband can ask to have his Orders ammended to be "Accompanied Tour" if it is allowed for his location. Even if he can get this done ASAP you will still need to wait for your AP or GC to get BACK INTO the USA later.

There was a real case where an American and Filipina married in the USA on a K1 Visa. Then the husband planned the honeymoon to the Bahamas just south of Flordia and they did NOT allow her back into the USA at that time. Her husband had made an honest error and not sure the final outcome or delays and extra expenses caused by this because she had no AP or GC.

AOS has 3 each NOA1 recieved

Biometrics was done mid April 2013.

SS Card changed to Married Name with Madien Name now middle name.

EAD / AP combo-card approved 18 MAY 2013.

AOS Interview was 28 MAY 2013, Approved.

Green Card with EAD/AP recieved 15 June 2013.

Yes you will need a Japanese visa. Your marriage has nothing to do with that. You are a RP citizen and that's that.

Yes of course, you will be needing a visa from JP.

thanks everyone. However I found out from emailing the PH Consulate of Japan here in Manila that I don't need a visa to enter Japan once married. Just command sponsorship and all that.
