Hi Freinds,

I will be sending all my docs to USCIS office very soon. Currently, my visa status is H1-B ( Work Permit) . I am in doubt if I should apply for EAD or not. EAD has advantages of saving taxes and If I go to India , I would not need stamping either. Other issue is that , if there is any issue in my GC processing , my H1-B would be gone too. So I am kind of confused whether to apply for EAD or not . I really want to though because looking for a job with EAD is much easier than H1-B.

Any advice on this would be very much appreciated.

EAD is free and will be approved in 3 months. What is the downside?

I will loose my current H1-B status. I heard people saying that if there is any problem with your GC processing, you will loose your EAD too.

So I just wanna make sure if applying EAD is safe enough.

You don't lose your H1B status. You only lose it if you use the EAD to get a job. So you could apply for the EAD and keep it as back up.

Why do you anticipate a problem with your GC processing? Are you applying based on your work or marriage?

I am applying mhy GC based on my marriage and I am pretty confident to get it. I was engaged last week with all cultural functions and will go for registered marriage next week. Do you think I should hire a attorney too ? I just spoke to one of my friend and he filed his GC in Seattle. Since his wife and him don't live at the same location they got an RFE. So he asked me to file all docs by myself but take an attorney along with me when I go for the interview. What do you suggest?

Okay, so as I said, you only lose your H1B if you decide to use your EAD. So you can just apply for it and keep it as a back up, in case you want to change your job or something.

This is a do-it-yourself site, so most people on here did it themselves and most people here think lawyers mess up your case. For complex cases it is good to get a lawyer, but no, I wouldn't recommend bringing one to the interview. That just makes the interviewing officer suspicious. What do you have to hide?

As long as you have a bona fide marriage and are not otherwise inadmissible, you will be approved.
