Hey,

My brother, who is US citizen submitted I-130 for me in June-13. Got the reciept number few days back.

Question:

1. What would be the next step? Shall we get Biometric notification? By when should we expect that?

2. What is the time frame in which we can expect to get visa - If everything goes well? Application was submitted in Vermont.

I am new to this world, support would be highly appreciated.

The wait for siblings to receive visas is currently around 12 years. I think your current next step is awaiting approval/denial of the I-130, after which you case will be forwarded to the NVC to await priority date.

Basically, you're waiting for your month to come up in the bulletins. This was this months, for example.

You'll see that siblings in the F4 category who filed in certain months many years ago are now eligible to get their visas (mostly 2001 filers). Where you are from will effect a little how quickly you can get yours.

Do we have some real cases here? Someone whose visa was approved in last few weeks - more specifically siblings. Quite a variable information is available - heard few cases where cases were completed in 40 months as well...

Just to clarify. The 40 months you probably heard of was likely for the petition to be approved. The petition approval can take many months in itself. Then, you still must wait for your priority date (which is counted in years - around 10 - 11 by the time your petition is approved).

All visas are two part processes. Petition application, then visa application. You brother has so far filed a petition. 12 years later, you will apply for your visa.

Approval time of the I-130 is irrelevant to the overall wait of 12 years. Approval of the I-130 is only the first step. After the I-130 is approved, there is still a long wait for an available visa. The waiting line for the visa is determined by when the I-130 was filed regardless of when it got approved.

If the I-130 is approved in one week or five years, the total wait time is still 12 years in both cases.

There is no difference between being approved in one week or five years. It's the same.

In fact, it is an advantage to have the I-130 approval take a long time because it would increase the CSPA protection if your brother has kids who will turn 21 while waiting the next 12 years to immigrate.

What you are saying is quite right. I have observed many cases in past with overall shorter timelines. It can be due to profile of person who is requesting the visa or something else..

The I130 may be approved quickly or slowly it is not what determines when you get a card. You need a visa number to be available in the class you are in. Refer to the current visa bulletin and you will see the wait is from 11 to 23 years depending on where you are from. Are you in the US now

This will not be over quickly. You will not enjoy this.

That is incorrect. The priority dates are the same for everyone (a few countries take even longer).

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

From what country are you?

There's an insane waiting period for siblings from the Philippines because it would take 23-24 YEARS before they can immigrate to the US.

I don't think you can adjust status in the US as the total waiting time is at least 12 years for F4 category (depending on your country). Unless you are of legal status in the US by the time your priority date becomes current.
