Custody Child for K1 visa

Dear all Member,

i just got approved our petition on 24 July, we didnt get the interview and Medical Check Up date yet, my question is i dont have custody child for my lil daughter, and i divorced since 2007 and dont realize if i need custody child as in Indonesia Law if the child under 12, the custody always in Mother;s hand, and i'm affraid if on the interview the officer ask the custody child. is there any experience of the member of VJ of it when you get interview, the officer always ask your custody child? and what happen if you dont have the custody child? the officer will pending you and your child K1/K2 visa or only your child visa?

we need enlightened...thankyou :)

If you don't have custody you normally need a notarized consent form from the father stating it is okay for the child to move to the USA. This will depend greatly on how they determine custody in your country. If the father isn't on the birth certificate it can often mean the mother has sole custody, but again, this is different for some countries.

Make sure you apply for the visa for your daughter. While she is a derivative of the I-129F she will need her own K2 visa in her passport.

How old is your child? Do you intend to take your child to the States with you? You need to apply for a visa for your child. Do some deep thinking, and good luck.

my daughter in 11 years old now, i will take her to State, but not this year, it will be next year as she want to finisih her primary school in indonesia first and she really loves her grand parents and dont want to leave them..

i did apply for her visa (K2 Visa)..and im affraid when the interview, the officer will not give her K2 visa...

the problem is, since her 1 years old, the father just leaving us, never see her and support her until now,

and on 2007, i apply divorce to court and that only need one trial, the judge gave the decision on that time..we divorced..

and now 6 year later, i just found out about custody child as i need it to take my child to State and some of my friends have been ask by officer about custody child, and some of them not..

now has been 11 years, i never know where is he or he still alive or not..i have no idea..thats mean i cant get the statement from her father stating his okay if i take my child to USA...

i do apply her K2 visa as is derivatives our petition i-129F, thats why im so affraid if the officer will ask me about the custody child....

Custody is determined by Indonesian laws.

Contact an Indonesian lawyer to see what is required for you to have the authority to move your child permanently to the US. Figure out under Indonesian laws on how you can get this done.

Agreed. You'll have to contact a lawyer to find out exactly what you need in your country to make sure you have sole custody.
