hi folks, this might sound dumb but I already know if the applicant has been divorced, he/she needs to include divorce decree with i-485...However, if the US citizen spouse has been divorced, not the alien applicant, do I still include a copy of divorce decree with i-485? Nowhere on the instructions can I find any wording on this so not sure.. could someone confirm? thanks!

Lemme clarify.. the situation is: US citizen has been divorced once... Alien applicant has never been divorced... do I include divorce paper in i-485?

Yes both divorce decrees (and any others if multiple marriages). The citizen's decree is probably asked for with the I-130 (which establishes their ability to petition a relative).

@Harpa Timsah, Thanks for the quick response. Yes, the citizen's divorce paper is included in i-130 already. So, you are saying I should include another copy in i-485? anywhere else? i-765? i-131?

No, I just meant that the decree must be in the package someplace. The I-130 asks for it so it goes with the I-130.

@Harpa Timsah thanks again. my apologies for being paranoid or nitpicking or annoying...but, a lot of docs have to go in more than one place in this i-130, 485, 765, 131 bundle filing, such as birth certificates.... that being said, should i include US sponsor's divorce decree.. I think I am gonna include another copy... now that i started thinking over this, i don't think i can go to sleep without including another copy :(

Nope. You can disagree if you want, but you don't need to needlessly double up on things. You need to provide everything each application asks for. Each application needs photos, for instance, but not every one needs a birth certificate, so that assertion is just plain wrong.

I have gone through this process with no RFEs; you can do what you like, though.
