I have some pretty unexpected and amazing news to all those who believe themselves to be interview waiver cases and will take months on end to receive their GC. Hopefully this will bring you all some much needed comfort:

My wife was an interview waiver case. Our receipt date was 07/03/2013. This Saturday, October 26, I got a text notification that my online status had changed. I thought "surely it would turn out that we were not, after all, an interview waiver case". And yet lo and behold, our status was in "Document/Card Production". WOOHOOOO!!!!!

That's an interview waiver approval in less than 4 months guys!!!

So don't lose hope y'all. I know that we hear a lot of horror stories on here about people waiting a year or something to get their GC, but maybe that phase has passed and USCIS is now starting to pick up their slack.

Congratulations! Unfortunately many of us January, February, and March filers (and even people who applied back in 2012) are still waiting, so I think you got extremely lucky. But nice to know they're working on us Interview Waivers at all.

i just called them today they told me you need to wait till we send u mail for interview date,time.......they didnt give me any reference number.they asked in which state & city u r living?once i told them atlanta ,ga they told me u r still in processing time right now we r working on jan 17,2013 cases...sad.png

Finally, after waiting for 64 days in "testing and interview" status i got my notice of interview today for a schedule on December 3. I wish it were earlier but I'm just happy to get a schedule finally. My interview schedule arrived 104 days after the initial receipt of my packet and 78 days after biometrics, not too bad of a wait.

So any July filers out here adjusting from the "others" category (tourist, student, non-K1/CR1, etc) that are still waiting for interview schedules?

I am trying to analyze the timeline trends. Those adjusting from K-1 seem to have the longest wait, specially those that have interview waivers. Others in that category are lucky enough to get an interview sched and automatic approval in 4 months or less. There are those adjusting from "others" that have received approvals in less than 3 months--even receiving EAD concurrent to GC.

In as far as EAD timelines go, it is pretty standard at about 90days tops but for GC there seems to be no rhyme or reason. Some are faster than others and I do not understand the factors that affect how quickly or soon a case is resolved. Initially, I was of the impression that doing a "walk-in" to your biometrics appointment sooner than your schedule can speed up a case but it seems like that is totally independent of the I-485/I-130 application. It could possibly speed up your I-765/EAD/AP but not AOS.

So, if anyone is in a sharing mood-- please state the visa you're adjusting from, when you submitted AOS papers, what local office (for interview) and how long (in no of days) before you got your interview schedule-- or note if still waiting.

Okay, here is an update from me. After USCIS received my RFE response on August 17, I still have not heard back from them with any sort of update and my status on the website is still "RFE response review". I just called them for the second time a few days ago and was told that, although it's been 60 days (it says on the status page that I can expect an update within 60 days) I will have to wait another 128 days before I can file a service request…that's based off of my local USCIS office's processing time.

I really hope I'll hear from them before those 128 days are up in March ClockWatch2.gif

My husband entered through K1.

We sent our AOS papers on July 16 and our case was route to the NBC on July 24.

Had Biometrics on August 23.

The EAD/AP Combo Card was ordered on September 17 and we received it on September 25.

We called the USCIS regarding the I485 on October 28 because case status online still reads Acceptance. They said that the local office (Hartford, CT) is still processing Feb 2013 applications and therefore to contact them again after 4 months (if no changes to the case.) They also mentioned that just because we haven't received an interview letter (nor an interview waiver letter), doesn't mean that we will (or will not) get an interview... The last time our I485 was touched was on July 24

Patience is key in all this... I've decided to not look at a Status Update until January/February for my sanity...

May 6, 2017 -- Received Interview Letter in the Mail.

June 8, 2017 -- Interview Passed!

June 16, 2017 -- Oath Ceremony! He is a USC!!

hi . what do you mean "interview waiver" ?

they would possibly not have me go through the interview process and just sent the green card if approved.

Family-based Form I-485, Application to Adjust Status, generally requires an interview to be conducted at the applicant's local service center. The requirement for these interviews is set under the Code of Federal Regulations (CFR 8, 246) which also provides that interviews may be waived in certain cases.

USCIS has authority to waive an interview if the case falls within one of the situations where an interview waiver can be granted. USCIS’s decision to waive the interview is based on standards set at the national level, and include adjustment categories in which there is normally enough evidence to make a decision without an interview, among the cases wherein interview can be waived is for K1/K2 entrants— Fiances of U.S. citizens and their children, cases where the applicant has been interviewed in the course of an investigation or field examination, and the adjudicating examiner determines that further interview of the applicant is unnecessary, and cases in which there is sufficient evidence contained in the record to support a denial of the adjustment of status application.

Interview waiver will not be granted for I-485 cases:

--With Supplement A to Form I-485, Adjustment of Status Under Section 245(i) (Penalty cases)

--With an EWI (Entry w/o Inspection) class of admission; or

--As part of a family packet; unless every application in the family packet meets the interview waiver criteria.

Finally our GC case status is changed to "Card/Document Production" on Nov 10th. We believe we were one of those interview waiver cases that have to wait for a long time but our case is approved in about 4 months!

Please don't lose hope guys and stay positive.
