Hello everyone, I just created my account on this website today, so I am a newbie to this website, and about the

visa stuff, so just bear with me.

Let me start this with introducing myself.

I am an exchange student from Asia(F-1 Visa), been in the states about two years now.

I met my girlfriend about two years ago, and now we are engaged.

We are planning on getting married next year November.

Yesterday, my girlfriend told me about the K-1 Visa, and I was wondering that is.

Here are my questions.

1. Will I able to go to school with my K-1 Visa?

2. How long does it take to get a K-1 Visa?

3. How much does it cost?

4. How long does it take to get a green card after you marry american spouse?

5. Is it easier for me to just get a lawyer to go through this stuff?

What I am mostly concerned about is that my student visa expires next year, and we are not getting married

until next year November. I don't want to go back to my country, and do the interview and renew my visa.

I would rather to stay here, and get the k-1 visa.

I was wondering that if I get my K-1 Visa, will I still be able to go to school, and stay here legally until I get my

Green card?

If you don't really get what I am trying to say here, please ask me again.

K-1 visa is for a foreign-born fiancé(e) of a US citizen to legally enter the US for the purpose of getting married. Since you are already in the US on a student visa, you do not want a K-1. If your student visa is expiring before your planned marriage date, then you have to leave the US and return to your home country to file for a K-1.

However, if you do not wish to leave the US, then you have to get married before your F-1 expires and file for a green card (form I-130) and do the adjustment of status (form I-145). The process will take on average 6 to 8 months to complete. However, I am unsure whether or not you can continue to study while the application is in process.

(as of March 14th, 2014)

ELIS status - Closed (Card produced)

USCIS case check with receipt number (starts with IOE) - Card delivered in the mail

SSN - Received (Went to SSA location to apply for one)
